【摘要】：《反壟斷法》和《行政訴訟法》對于我國行政壟斷的規(guī)制效果有限,迫切需要公平競爭審查規(guī)制的有力補(bǔ)充。但是,由于我國的公平競爭審查制度才剛剛起步,具體實施機(jī)制尚未成熟,存在"自我審查"為主難以保證審查效果,激勵機(jī)制缺失難保責(zé)任主體主動性以及審查標(biāo)準(zhǔn)、程序概括化導(dǎo)致可操作性較低的問題。因此,有必要建立以"自我審查"為輔的審查機(jī)制,確立政策制定機(jī)關(guān)的激勵、懲戒機(jī)制,同時細(xì)化公平競爭審查的具體標(biāo)準(zhǔn)、程序,從而對我國的公平競爭審查機(jī)制進(jìn)行優(yōu)化,進(jìn)而更加全面、高效地規(guī)制行政壟斷行為。
[Abstract]:Anti-monopoly Law and Administrative Litigation Law have limited effect on the regulation of administrative monopoly in our country, so it is urgent to supplement the regulation of fair competition review. However, due to the fact that the fair competition examination system in our country has just started, the concrete implementation mechanism is not mature, it is difficult to guarantee the effect of the review by "self-examination", and the incentive mechanism lacks the initiative of the subject of responsibility and the standard of review. The generalization of the procedure leads to the problem of low maneuverability. Therefore, it is necessary to establish a review mechanism supplemented by "self-censorship", to establish incentives and disciplinary mechanisms for policy-making organs, and to refine the specific standards and procedures of fair competition review. In order to optimize our fair competition review mechanism, and then more comprehensive and efficient regulation of administrative monopoly behavior.
