【摘要】：平衡反壟斷法與知識(shí)產(chǎn)權(quán)之間的關(guān)系是世界各國(guó)普遍面臨的難題,我國(guó)雖然頒布施行了《中華人民共和國(guó)反壟斷法》,明確了反壟斷法適用于知識(shí)產(chǎn)權(quán)領(lǐng)域,但由于相關(guān)法律條文過于原則,并不能為知識(shí)產(chǎn)權(quán)領(lǐng)域反壟斷執(zhí)法提供實(shí)際的指導(dǎo)。應(yīng)在理清反壟斷與知識(shí)產(chǎn)權(quán)之間關(guān)系的前提下,立足于我國(guó)具體國(guó)情,同時(shí)借鑒國(guó)外發(fā)達(dá)國(guó)家的相關(guān)經(jīng)驗(yàn),解決反壟斷法在知識(shí)產(chǎn)權(quán)領(lǐng)域的適用問題。我國(guó)對(duì)于反壟斷法在知識(shí)產(chǎn)權(quán)領(lǐng)域適用應(yīng)持適度寬松的態(tài)度,應(yīng)盡快出臺(tái)反壟斷法在知識(shí)產(chǎn)權(quán)領(lǐng)域適用相關(guān)指南,促進(jìn)我國(guó)知識(shí)產(chǎn)權(quán)領(lǐng)域反壟斷執(zhí)法的順利推行。
[Abstract]:Balancing the relationship between anti-monopoly law and intellectual property rights is a difficult problem all over the world. Although China has promulgated and implemented the Anti-monopoly Law of the people's Republic of China, it is clear that the anti-monopoly law is applicable to the field of intellectual property rights. However, because the relevant legal provisions are too principled, it can not provide practical guidance for antitrust law enforcement in the field of intellectual property. On the premise of clarifying the relationship between antitrust and intellectual property, we should base ourselves on the specific conditions of our country and learn from the relevant experiences of foreign developed countries to solve the application of antitrust law in the field of intellectual property. Our country should hold a moderate lenient attitude towards the application of antimonopoly law in the field of intellectual property, and should issue relevant guidelines for the application of antimonopoly law in the field of intellectual property as soon as possible, so as to promote the smooth implementation of anti-monopoly law in the field of intellectual property in our country.
