【摘要】：試驗(yàn)性金融監(jiān)管,主要是指具有一定金融監(jiān)管職能的主體為支持金融創(chuàng)新及推行金融監(jiān)管創(chuàng)新而依法依規(guī)開展的試驗(yàn)性的監(jiān)督和管理活動(dòng)以及由此形成的一系列具有試驗(yàn)性質(zhì)的金融監(jiān)督和管理理念、方法、制度、立法、模式等的總稱。試驗(yàn)性金融監(jiān)管的基本原則主要包括社會(huì)公益原則、利益平衡原則和比例監(jiān)管原則。試驗(yàn)性金融監(jiān)管法律規(guī)制的合理性基礎(chǔ)包括思想理論基礎(chǔ)和現(xiàn)實(shí)必要性基礎(chǔ)兩方面。試驗(yàn)性金融監(jiān)管法律規(guī)制的思想理論基礎(chǔ)包括金融監(jiān)管法的優(yōu)化監(jiān)管原則、盧梭的社會(huì)契約論和人民主權(quán)論以及洛克的有限政府理論;試驗(yàn)性金融監(jiān)管的法律規(guī)制的現(xiàn)實(shí)必要性基礎(chǔ)表現(xiàn)在以下三方面:試驗(yàn)性金融監(jiān)管的規(guī)范實(shí)施需要法律規(guī)制,支持金融創(chuàng)新和保護(hù)金融投資者、消費(fèi)者權(quán)益需要法律保障,規(guī)范的試驗(yàn)性金融監(jiān)管體制的形成需要法律支持。

The rational basis of the legal regulation of experimental financial supervision includes the ideological and theoretical basis and the realistic necessity basis. The ideological and theoretical basis of legal regulation of experimental financial supervision includes the principles of optimizing supervision of financial supervision law, Rousseau's theory of social contract and people's sovereignty, and Locke's theory of limited government. The realistic necessity of the legal regulation of experimental financial supervision lies in the following three aspects: the regulation of experimental financial supervision needs legal regulation, the support of financial innovation and the protection of financial investors, and the protection of consumers' rights and interests. The formation of standardized experimental financial supervision system needs legal support.
