互聯(lián)網(wǎng)金融監(jiān)管的法律規(guī)制研究

【摘要】:互聯(lián)網(wǎng)金融是傳統(tǒng)金融機構(gòu)與互聯(lián)網(wǎng)企業(yè)聯(lián)合以互聯(lián)網(wǎng)技術(shù)和信息通信技術(shù)為支撐,實現(xiàn)資金融通、支付、投資和信息中介服務(wù)為一體的新型金融業(yè)務(wù)模式;ヂ(lián)網(wǎng)金融是金融發(fā)展和信息技術(shù)發(fā)展相結(jié)合的產(chǎn)物,也是我國金融體系中的重要組成部分,在社會經(jīng)濟發(fā)展中發(fā)揮著巨大的作用。其中,互聯(lián)網(wǎng)支付、網(wǎng)絡(luò)借貸和股權(quán)眾籌融資是目前最常見的三種業(yè)態(tài)模式,與我們生活最緊密相關(guān)。然而,由于互聯(lián)網(wǎng)金融監(jiān)管的法律體系不完善,相關(guān)法律法規(guī)不健全,一定程度上制約了其進(jìn)一步發(fā)展。因此,本論文希望通過一定的研究,來對互聯(lián)網(wǎng)金融監(jiān)管的法律規(guī)制提出完善建議,從而減少互聯(lián)網(wǎng)金融發(fā)展的阻礙,促進(jìn)互聯(lián)網(wǎng)金融的健康快速發(fā)展。論文以互聯(lián)網(wǎng)支付、網(wǎng)絡(luò)借貸、股權(quán)眾籌融資為中心,從互聯(lián)網(wǎng)金融基礎(chǔ)理論談起,介紹了互聯(lián)網(wǎng)金融的特征、模式等,目的是通過概要性的分析,掃除互聯(lián)網(wǎng)金融方面的“盲區(qū)”以及認(rèn)識誤區(qū)。接著研究我國互聯(lián)網(wǎng)金融監(jiān)管監(jiān)管主體的現(xiàn)狀和監(jiān)管法律制度的現(xiàn)狀,可知目前我國對于互聯(lián)網(wǎng)金融監(jiān)管的監(jiān)管主體存在職權(quán)不清、多頭監(jiān)管等問題,而法律制度也尚不健全,雖有部分針對互聯(lián)網(wǎng)金融監(jiān)管制度的規(guī)定散見于各種法律法規(guī)中,但由于立法和監(jiān)管的滯后,導(dǎo)致缺乏一套專門性法律體系來規(guī)制監(jiān)管中出現(xiàn)的問題,致使我國互聯(lián)網(wǎng)金融潛在的風(fēng)險不斷積累,產(chǎn)生了諸如不正當(dāng)競爭、互聯(lián)網(wǎng)金融消費者的權(quán)益受到損害等各種問題,可見加強我國互聯(lián)網(wǎng)金融的監(jiān)管存在相當(dāng)?shù)谋匾浴Υ?文中通過比較美國、英國、德國、歐盟等國家及地區(qū)的法治實踐狀況,總結(jié)了國外的成功經(jīng)驗,希望通過借鑒其完善法律體系、確立監(jiān)管模式、堅固互聯(lián)網(wǎng)“防火墻”幾方面的經(jīng)驗來完善我國的互聯(lián)網(wǎng)金融法律監(jiān)管制度。本文在最后部分提出了幾點建議作為研究結(jié)論,一是設(shè)立專門的政府監(jiān)管機構(gòu),從而保障監(jiān)管的順利進(jìn)行;二是建立互聯(lián)網(wǎng)金融監(jiān)管法律體系,來為互聯(lián)網(wǎng)金融的健康發(fā)展保駕護(hù)航;三是加強征信體系的法律建設(shè),以提高互聯(lián)網(wǎng)金融交易的效率并有效管理互聯(lián)網(wǎng)金融市場;四是加強參與者信息保護(hù)的法律監(jiān)管,以保障互聯(lián)網(wǎng)金融參與者的合法權(quán)益;五是發(fā)揮司法能動作用,及時對互聯(lián)網(wǎng)金融市場出現(xiàn)的問題進(jìn)行監(jiān)管;六是創(chuàng)新監(jiān)管模式,發(fā)動群眾打擊涉及互聯(lián)網(wǎng)金融的違法行為;七是實行行業(yè)自治,充分發(fā)揮行業(yè)組織促進(jìn)互聯(lián)網(wǎng)金融健康發(fā)展的作用。最后,希望本篇論文能為相關(guān)部門在制定互聯(lián)網(wǎng)金融監(jiān)管法律法規(guī)時提供一定的借鑒,從而使我國的互聯(lián)網(wǎng)金融更健康良性地發(fā)展。
[Abstract]:Internet finance is a new financial business model, which is supported by Internet technology and information communication technology, and realizes the financing, payment, investment and information intermediary service of traditional financial institutions and Internet enterprises. Internet finance is the product of the combination of financial development and information technology development. It is also an important part of China's financial system and plays a great role in the development of social economy. Internet payment, online lending and crowdfunding are the three most common business models, most closely related to our lives. However, because the legal system of Internet financial supervision is not perfect and the relevant laws and regulations are not perfect, it restricts its further development to a certain extent. Therefore, this paper hopes to improve the legal regulation of Internet financial supervision through certain research, so as to reduce the obstacles to the development of Internet finance and promote the healthy and rapid development of Internet finance. Based on the basic theory of Internet finance, this paper introduces the characteristics and models of Internet finance. The purpose of this paper is to analyze the characteristics of Internet finance through a brief analysis. Wipe out the Internet finance, "blind zone" and misunderstanding. Then it studies the current situation of the main body of Internet financial supervision and the current situation of the legal system of supervision in our country. It can be seen that there are some problems such as unclear functions and powers of the subject of supervision of Internet financial supervision in our country at present, and many problems such as multi-supervision, and the legal system is not yet perfect. Although some regulations on Internet financial supervision system are scattered in various laws and regulations, due to the lag of legislation and supervision, there is a lack of a special legal system to regulate the problems in supervision. As a result of the accumulation of potential risks of Internet finance in China, such as unfair competition, the rights and interests of Internet financial consumers have been damaged, so it is necessary to strengthen the supervision of Internet finance in China. In this paper, by comparing the practice of the rule of law in the United States, the United Kingdom, Germany, the European Union and other countries and regions, the author sums up the successful experience of foreign countries and hopes to establish a regulatory model by using it as a reference to perfect the legal system. Strengthen the experience of Internet firewall to perfect the legal supervision system of internet finance in our country. In the last part of this paper, some suggestions are put forward as the conclusion of the research. One is to set up a special government regulatory agency to ensure the smooth progress of supervision, and the other is to establish a legal system of Internet financial supervision. To protect the healthy development of Internet finance; third, to strengthen the legal construction of the credit information system in order to improve the efficiency of Internet financial transactions and to effectively manage the Internet financial market; and fourth, to strengthen the legal supervision of the information protection of participants. In order to protect the legitimate rights and interests of Internet financial participants, the fifth is to give full play to the role of judicial initiative, timely supervision of the Internet financial market problems, sixth, innovative regulatory model, mobilize the masses to crack down on illegal acts involving Internet finance; Seventh, practice industry autonomy, give full play to the role of industry organizations to promote the healthy development of Internet finance. Finally, I hope this paper can provide some reference for relevant departments in formulating laws and regulations of Internet financial supervision, so as to make our country's Internet finance develop more healthily and healthily.
