【摘要】:互聯(lián)網(wǎng)科技的不斷發(fā)展和普及帶動(dòng)了全世界范圍內(nèi)電子商務(wù)行業(yè)的迅速崛起。越來越多的經(jīng)營者將精力投放于網(wǎng)絡(luò)市場(chǎng)的開發(fā)和運(yùn)用,試圖利用互聯(lián)網(wǎng)的優(yōu)勢(shì)最大限度的配合自身的商業(yè)競(jìng)爭(zhēng)行為。與此同時(shí),社會(huì)大眾的交易習(xí)慣和生活方式也因此發(fā)生了巨大的變化,網(wǎng)絡(luò)宣傳逐漸成為影響消費(fèi)者選擇商品和服務(wù)的首要因素。一些不法經(jīng)營者為了爭(zhēng)奪有利的市場(chǎng)優(yōu)勢(shì),排擠打壓同行業(yè)競(jìng)爭(zhēng)對(duì)手,有意識(shí)的利用網(wǎng)絡(luò)科技從事虛假宣傳等不正當(dāng)競(jìng)爭(zhēng)行為。相較于傳統(tǒng)的虛假宣傳行為,網(wǎng)絡(luò)的虛擬性和開放性使其具有更強(qiáng)的危害性和更廣泛的影響。它往往會(huì)給同業(yè)競(jìng)爭(zhēng)者和消費(fèi)者造成難以估量的損失,嚴(yán)重破壞了網(wǎng)絡(luò)市場(chǎng)的良性競(jìng)爭(zhēng)秩序。由于我國網(wǎng)絡(luò)市場(chǎng)經(jīng)濟(jì)仍處于初步發(fā)展階段,尚未形成成熟的網(wǎng)絡(luò)立法體系,還沒有對(duì)于網(wǎng)絡(luò)虛假宣傳行為進(jìn)行規(guī)制的直接法律依據(jù)。實(shí)踐中一般援引《反不正當(dāng)競(jìng)爭(zhēng)法》中的原則性規(guī)定對(duì)其進(jìn)行界定和裁判,可操作性和適用性較差,加之各級(jí)立法機(jī)關(guān)的規(guī)定缺乏統(tǒng)一性和協(xié)調(diào)性,導(dǎo)致其在理解和運(yùn)用上都比較混亂。而以政府強(qiáng)制規(guī)制為主導(dǎo)的規(guī)制模式和落后的監(jiān)管手段也難以應(yīng)對(duì)網(wǎng)絡(luò)虛假宣傳行為隱蔽性更強(qiáng)、損害范圍更廣的新特點(diǎn),無法實(shí)現(xiàn)對(duì)其全面而準(zhǔn)確的監(jiān)管。不論是出于對(duì)網(wǎng)絡(luò)市場(chǎng)良性競(jìng)爭(zhēng)秩序的維護(hù),還是對(duì)同業(yè)競(jìng)爭(zhēng)者和消費(fèi)者合法權(quán)益的保護(hù),網(wǎng)絡(luò)虛假宣傳行為都理應(yīng)成為檢查監(jiān)督部門的重點(diǎn)監(jiān)管對(duì)象,亟需完善的立法體系和先進(jìn)的監(jiān)管手段予以有效的規(guī)制。本文從我國電子商務(wù)發(fā)展現(xiàn)狀出發(fā),以網(wǎng)絡(luò)虛假宣傳行為為切入點(diǎn),對(duì)比美歐國家的反網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)立法模式,剖析我國當(dāng)前相關(guān)立法體系和規(guī)制手段的不足,對(duì)我國網(wǎng)絡(luò)虛假宣傳的規(guī)制進(jìn)行系統(tǒng)的研究。在充分運(yùn)用比較研究、實(shí)證研究等方法的基礎(chǔ)上,提出一套針對(duì)網(wǎng)絡(luò)虛假宣傳行為的科學(xué)有效的規(guī)制體系,以促進(jìn)我國電子商務(wù)的繁榮發(fā)展,為我國規(guī)制以網(wǎng)絡(luò)虛假宣傳為代表的網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)行為盡綿薄之力。
[Abstract]:The continuous development and popularization of Internet technology has driven the rapid rise of e-commerce all over the world. More and more operators put their energy into the development and application of the network market and try to make use of the advantages of the Internet to maximize their business competition. At the same time, the trading habits and lifestyle of the public have changed greatly, and Internet propaganda has gradually become the primary factor affecting consumers' choice of goods and services. In order to compete for the advantageous market advantage, some illegal operators squeeze out and suppress their competitors in the same industry, and consciously use network technology to engage in unfair competition, such as false propaganda. Compared with the traditional false propaganda behavior, the virtual and open nature of the network makes it more harmful and more extensive. It often causes incalculable losses to competitors and consumers, and seriously damages the healthy competition order of the network market. Since our country's network market economy is still in the initial stage of development, it has not yet formed a mature network legislation system, and there is no direct legal basis for regulating the network false propaganda behavior. In practice, the principled provisions of the Anti-unfair Competition Law are generally invoked to define and adjudicate them, which are of poor maneuverability and applicability, coupled with the lack of uniformity and coordination of the provisions of the legislative organs at all levels. It leads to confusion in understanding and application. However, the regulatory model and backward regulatory means, which are dominated by government compulsory regulation, can not cope with the new characteristics of network false propaganda, such as stronger concealment and wider range of damage, and can not achieve comprehensive and accurate supervision. Whether it is to maintain the healthy competition order in the network market or to protect the legitimate rights and interests of competitors and consumers in the same industry, the false propaganda on the network should be the focus of supervision and control of the inspection and supervision department. It is urgent to improve the legislative system and the advanced regulatory means to effectively regulate. Based on the current situation of electronic commerce development in China, this paper contrasts the anti-network unfair competition legislation model of the United States and Europe, and analyzes the deficiency of the current relevant legislation system and regulation means of our country, taking the false propaganda behavior of the network as the starting point. This paper makes a systematic study on the regulation of false propaganda on the Internet in China. On the basis of comparative research and empirical research, a set of scientific and effective regulation system is put forward to promote the prosperity and development of electronic commerce in China. In order to regulate the network unfair competition represented by the network false propaganda.
