【摘要】：反思是學(xué)術(shù)進(jìn)步的動(dòng)力,通過對(duì)經(jīng)濟(jì)法學(xué)的反思,我們可以發(fā)現(xiàn)其存在非常突出的重權(quán)力、輕權(quán)利問題。這種"權(quán)利缺失"現(xiàn)象說明了經(jīng)濟(jì)法權(quán)利理論的嚴(yán)重不足,將給經(jīng)濟(jì)法理論體系帶來災(zāi)難性后果,導(dǎo)致經(jīng)濟(jì)法學(xué)在思想市場(chǎng)的競(jìng)爭(zhēng)中面臨生存危機(jī)。對(duì)此,必須清醒地認(rèn)識(shí)到經(jīng)濟(jì)法學(xué)的學(xué)術(shù)使命,通過方法論與范式轉(zhuǎn)型等措施,加快經(jīng)濟(jì)法權(quán)利理論的建設(shè)。
[Abstract]:Reflection is the motive force of academic progress. Through the reflection of economic law, we can find that there is a very prominent problem of attaching importance to power rather than right. This phenomenon of "lack of rights" shows that the theory of economic law rights is seriously inadequate, which will bring disastrous consequences to the theoretical system of economic law and lead to the existence crisis of economic law in the competition of ideological market. In view of this, we must soberly realize the academic mission of economic law, and speed up the construction of economic law right theory by means of methodology and paradigm transformation.
