【摘要】：在網(wǎng)絡游戲直播中,存在著違反《中華人民共和國反不正當競爭法》一般條款與違反具體條款兩種不正當競爭行為,而不正當競爭行為的認定則有基于商業(yè)模式與行為構成兩種路徑。競爭法規(guī)制網(wǎng)絡游戲直播中的不正當競爭行為具有必要性與合理性:既是修正著作權制度的自身缺陷使然,也是反不正當競爭法的自身優(yōu)勢而引致。競爭法規(guī)制網(wǎng)絡游戲直播中的不正當競爭行為面臨著"一增一減"的雙重困境:法律適用不確定性的增強和保護效度的減弱。破解網(wǎng)絡游戲直播中不正當競爭行為的競爭法規(guī)制困境,一方面要將競爭法中的一般條款限定與具體條款配合有機結合起來,以推動競爭法適用的客觀化;另一方面,要對《中華人民共和國反不正當競爭法》的內(nèi)部規(guī)則及司法適用進行適度優(yōu)化和調整,以補強競爭法規(guī)制的保護力度。
[Abstract]:In the live broadcast of online games, there are two kinds of unfair competition acts: violating the general provisions of the Anti-unfair Competition Law of the people's Republic of China and violating the specific provisions. The identification of unfair competition is based on business model and behavior constitute two ways. It is necessary and reasonable for competition law to regulate the unfair competition behavior in online game broadcasting: it is not only the reason of correcting the defects of copyright system, but also the advantage of anti-unfair competition law. The competition law regulates the unfair competition behavior in the online game direct broadcast facing the double dilemma of "one increase and one decrease": the uncertainty of the application of the law is enhanced and the validity of the protection is weakened. On the one hand, we should combine the general terms of competition law with specific provisions to promote the objectivity of competition law application. The internal rules and judicial application of the Anti-unfair Competition Law of the people's Republic of China should be appropriately optimized and adjusted in order to strengthen the protection of competition law.
