【摘要】：互聯(lián)網(wǎng)技術(shù)飛速發(fā)展,網(wǎng)約車的出行方式在給民眾帶來方便的同時(shí)也因各方定位模糊責(zé)任不清等原因引起諸多爭議,需要從理論和規(guī)范層面厘清網(wǎng)約車平臺(tái)公司的經(jīng)營定位,進(jìn)而確定其應(yīng)承擔(dān)的民事責(zé)任。本文要主要通過對有關(guān)網(wǎng)約車管理規(guī)定內(nèi)容的分析,闡述網(wǎng)約車平臺(tái)公司與巡游出租車服務(wù)公司存在著本質(zhì)的差異,現(xiàn)行規(guī)定將網(wǎng)約車平臺(tái)公司定位為出租車服務(wù)公司存在諸多缺陷。網(wǎng)約車平臺(tái)公司在網(wǎng)約車服務(wù)中主要提供網(wǎng)絡(luò)信息服務(wù),現(xiàn)行管理規(guī)定將其定位為承運(yùn)人的做法存在諸多問題,將網(wǎng)約車平臺(tái)公司與車輛提供者之間確定為勞動(dòng)關(guān)系也與事實(shí)和法理不符。為了規(guī)范和推動(dòng)網(wǎng)約車的發(fā)展,將網(wǎng)約車平臺(tái)公司與出租車輛提供者確定為共同經(jīng)營者的定位比較可行,他們之間應(yīng)該是共同經(jīng)營關(guān)系而非勞動(dòng)關(guān)系。網(wǎng)約車平臺(tái)公司雖然通過網(wǎng)絡(luò)提供租車信息,但是在整個(gè)網(wǎng)約車服務(wù)中也不宜將其界定為居間人,而是與車輛提供者一起承擔(dān)共同經(jīng)營者責(zé)任,該責(zé)任既有合同責(zé)任又有侵權(quán)責(zé)任。
[Abstract]:With the rapid development of Internet technology and the convenience to the public in the way of traveling by car, it is necessary to clarify the operating position of the ride-hailing platform company from the theoretical and normative aspects, while at the same time causing many controversies due to the ambiguity of the location of all parties. And then determine its civil liability. In this paper, through the analysis of the contents of the regulations on the management of ride-hailing, the paper expounds the essential differences between the ride-hailing platform company and the tour taxi service company. There are many defects in the current regulations to position the ride-hailing platform company as a taxi service company. The network car-hailing platform company mainly provides the network information service in the network ride-hailing service, the current management regulations will position it as the carrier, there are many problems. It is also inconsistent with the facts and legal principles to determine the labor relationship between the ride-hailing platform company and the vehicle provider. In order to standardize and promote the development of ride-sharing network, it is more feasible to define the company and the provider of rental vehicle as co-operators, which should be a joint business relationship rather than a labor relationship. Although the ride-sharing platform company provides rental information through the network, it is not appropriate to define it as a broker in the whole network of ride-sharing services, but to share the responsibility of the operator with the vehicle provider. The liability includes both contractual liability and tort liability.
