【摘要】：保單持有人權(quán)益保護是人身險公司破產(chǎn)清算制度中的重要內(nèi)容。在未來我國保險公司破產(chǎn)清算法律制度建立健全中,為貫徹對保險交易弱勢一方的權(quán)益保護,應從負債端,將未到期保單利益及退保利益納入其中,充實保單持有人保險債權(quán)的實體權(quán)利內(nèi)容;從資產(chǎn)端,明確人身險公司各類財產(chǎn)的法律屬性,本著有利清算的原則真實反映金融機構(gòu)的清算價值;從配套端,嚴格限制非以保單持有人為直接對象的保險保障基金動用情形,使保障基金制度回歸其制度初衷。
[Abstract]:The protection of the rights and interests of policy holders is an important part of the bankruptcy liquidation system of life insurance companies. In the future, in order to protect the rights and interests of the weak party in insurance transactions, in order to protect the rights and interests of the weak party in insurance transactions, in order to establish and improve the legal system of bankruptcy liquidation of insurance companies in our country, we should include the unexpired policy interests and the recoupment interests from the To enrich the substantive rights of insurance claims of policy holders; to clarify the legal attributes of all types of property of life insurance companies from the asset side; to truly reflect the liquidation value of financial institutions in line with the principle of favorable liquidation; from the supporting end, The use of insurance protection funds, which are not directly targeted at policy holders, is strictly restricted, so that the security fund system returns to its original intention.
