【摘要】：伴隨著科學(xué)技術(shù)的不斷發(fā)展和進步,商業(yè)預(yù)付卡因其具有方便快捷、促進交易、節(jié)約交易成本等方面的優(yōu)勢已迅速滲透到各行各業(yè)中,成為市場經(jīng)濟中不可或缺的一部分。但是,我國商業(yè)預(yù)付卡出現(xiàn)的比較晚,法律規(guī)制也不是很完善,以至于在社會生活中出現(xiàn)了各種問題。本文正是以商業(yè)預(yù)付卡法律規(guī)制過程中存在的問題為基礎(chǔ),通過分析其產(chǎn)生的原因,來提出相對應(yīng)的完善對策。本文主要分為四章對商業(yè)預(yù)付卡法律規(guī)制進行闡述:第一部分,對商業(yè)預(yù)付卡的概念、特征進行分析,總結(jié)目前學(xué)術(shù)界對商業(yè)預(yù)付卡性質(zhì)的不同觀點,嘗試對預(yù)付卡的性質(zhì)進行界定以及對預(yù)付卡交易中涉及的法律關(guān)系進行分析。第二部分,結(jié)合我國的實際情況找出商業(yè)預(yù)付卡法律規(guī)制出現(xiàn)的問題,著重對信用風(fēng)險、金融安全、稅收監(jiān)管、備付金安全等四個方面的問題進行研究分析,并剖析產(chǎn)生這些問題的主要原因。第三部分,對國外商業(yè)預(yù)付卡法律規(guī)制進行比較分析,該部分對美國和日本的法律規(guī)制比較分析,找到最適合我國國情的關(guān)于商業(yè)預(yù)付卡法律規(guī)制的道路。借鑒國外的經(jīng)驗,從中得到啟示,不斷完善我國的法律規(guī)范體系。第四部分,就如何完善我國商業(yè)預(yù)付卡法律規(guī)制提出相關(guān)的建議,主要是從建立商業(yè)預(yù)付卡的準(zhǔn)入制度、強化監(jiān)管、完善法律責(zé)任制度等方面提出完善的對策,以期對完善我國商業(yè)預(yù)付法律規(guī)制起到一定的促進作用。
[Abstract]:With the continuous development and progress of science and technology, commercial prepaid cards have become an indispensable part of the market economy because of their advantages of convenience, convenience, trade promotion, transaction cost saving and so on. However, commercial prepaid cards in China appear late and legal regulations are not perfect, so that there are various problems in social life. Based on the problems existing in the legal regulation of commercial prepaid cards, this paper puts forward the corresponding perfect countermeasures by analyzing the causes of their emergence. This paper is divided into four chapters to explain the legal regulation of commercial prepaid card. The first part analyzes the concept and characteristics of commercial prepaid card and summarizes the different viewpoints of the current academic community on the nature of commercial prepaid card. This paper attempts to define the nature of prepaid cards and analyze the legal relationship involved in prepaid card transactions. The second part, combined with the actual situation of our country to find out the commercial prepaid card legal regulation problems, focusing on the credit risk, financial security, tax supervision, reserve security and other four aspects of research and analysis, And analyze the main causes of these problems. The third part makes a comparative analysis on the legal regulation of commercial prepaid cards in foreign countries. In this part, the author makes a comparative analysis of the legal regulations between the United States and Japan, and finds out the most suitable way for the legal regulation of commercial prepaid cards in China. Draw lessons from the experience of foreign countries, from which to get inspiration, constantly improve our legal system. In the fourth part, the author puts forward some suggestions on how to perfect the legal regulation of commercial prepaid card, mainly from the aspects of establishing the admission system of commercial prepaid card, strengthening supervision, perfecting the legal liability system and so on. In order to improve the legal regulation of commercial prepayment play a certain role in promoting.
