【摘要】：高等院校是“象牙塔”,在任何社會里都是十分圣潔的“殿堂”�！暗钐谩崩锏睦蠋熓恰叭祟愳`魂的工程師”,是教書育人的“園丁”。學(xué)高為師,德高為范。高等教育的思想品德、人格精神應(yīng)該成為社會民眾的典范,否則難以“為人師表”,更不能培養(yǎng)和造就社會的棟梁之才。近年來,隨著我國高等院校的擴(kuò)招和高等教育的普及,高等院校的辦學(xué)規(guī)模日益擴(kuò)大,高校參與的經(jīng)濟(jì)活動也越來越多,高校與社會的接觸也越來越密切,與之相應(yīng)的我國高等院校的商業(yè)賄賂問題也引起了社會的高度關(guān)注,我國高校商業(yè)賄賂犯罪呈現(xiàn)出高發(fā)趨勢。高等院校里出現(xiàn)商業(yè)賄賂犯罪是社會進(jìn)步發(fā)展過程中產(chǎn)生的毒瘤,其對我國高校的危害十分巨大。國外很多高校的發(fā)展歷程告訴我們,商業(yè)賄賂犯罪對于高等教育而言是一個需要花費(fèi)大力氣去除的頑疾固癥。隨著市場經(jīng)濟(jì)對我國高等院校的沖擊越來越大,我國高校的經(jīng)濟(jì)活動日益增多,與世界上其他國家一樣商業(yè)賄賂犯罪也已經(jīng)成為困擾我國高校發(fā)展的巨大問題。尤其是在近些年來我國高校改革不斷地深入的背景下,我國高校規(guī)模不斷擴(kuò)大、招生規(guī)模不斷增多,我國高校內(nèi)發(fā)生的商業(yè)賄賂犯罪也越來越多。在這種情形之下,研究我國高校商業(yè)賄賂的現(xiàn)狀與存在問題,并提出相應(yīng)的對策是具有十分重要現(xiàn)實意義的一件事情。高校商業(yè)賄賂是市場經(jīng)濟(jì)消極因素對我國高等教育事業(yè)的沖擊,這種沖擊腐蝕了一大批高等院校內(nèi)的領(lǐng)導(dǎo)干部與工作人員,損害了高等院校的良好社會形象,極大地?fù)p害了高校師生與人民群眾的切身利益。本文首先對高校商業(yè)賄賂的定義進(jìn)行了界定并介紹了高校商業(yè)賄賂的表現(xiàn)形式,分析了我國高校商業(yè)賄賂的現(xiàn)狀及高校反商業(yè)賄賂存在的問題,在借鑒國外高校反商業(yè)賄賂經(jīng)驗的基礎(chǔ)上,針對我國高校反商業(yè)賄賂中存在的問題,提出了我國高校反商業(yè)賄賂的對策。我國高校商業(yè)賄賂呈現(xiàn)出涉案領(lǐng)域較為固定、行賄受賄隱蔽導(dǎo)致調(diào)查取證困難、行賄受賄方式較為多樣化、高校受賄人員集體化的特征。我國高等院校商業(yè)賄賂主要集中在四個領(lǐng)域：招生領(lǐng)域、物資采購領(lǐng)域、基本建設(shè)領(lǐng)域以及高校后勤產(chǎn)業(yè)領(lǐng)域。目前我國高校反商業(yè)賄賂工作在中存在著一些問題,在法律制度上尚未形成完善規(guī)范的反商業(yè)賄賂法規(guī)體系,司法懲處上懲處力度較輕對犯罪人員的警戒懲罰作用不大。我國高等院校的反商業(yè)賄賂工作是一項復(fù)雜的系統(tǒng)性工程,我們要在借鑒國內(nèi)外相關(guān)反商業(yè)賄賂經(jīng)驗的基礎(chǔ)上,采取多項措施。我們要完善法律制度建設(shè),使之不敢犯罪；推動高校去行政化,使之不易犯罪；強(qiáng)化高校監(jiān)督機(jī)制,使之不能犯罪。
[Abstract]:Institutions of higher learning are ivory towers, very holy halls in any society. The teacher in the Palace is the engineer of the human soul and the gardener who teaches and educates. Learning high is a teacher, and virtue is a norm. The ideological and moral character and personality spirit of higher education should become the model of the social masses, otherwise, it is difficult to "be a teacher", let alone cultivate and bring up the talents of the pillars of society. In recent years, with the expansion of enrollment and popularization of higher education in our country, the scale of running colleges and universities is expanding day by day, the economic activities of colleges and universities are more and more, and the contact between universities and society is becoming closer and closer. The problem of commercial bribery in colleges and universities in our country has also aroused great concern from the society, and the crime of commercial bribery in colleges and universities in our country has shown a tendency of high incidence. The emergence of commercial bribery crime in colleges and universities is a malignant tumor in the process of social progress and development, and its harm to colleges and universities in our country is very great. The development of many foreign colleges and universities tells us that the crime of commercial bribery is a stubborn disease that needs to be eliminated with great effort. With the impact of market economy on colleges and universities in our country, the economic activities of colleges and universities in our country are increasing day by day. The crime of commercial bribery, like other countries in the world, has become a huge problem puzzling the development of colleges and universities in our country. Especially in recent years, under the background of college reform, the scale of colleges and universities in our country is expanding, the enrollment scale is increasing, and the crime of commercial bribery is also more and more occurring in colleges and universities in our country. Under such circumstances, it is of great practical significance to study the present situation and existing problems of commercial bribery in colleges and universities in China, and to put forward corresponding countermeasures. Commercial bribery in colleges and universities is the impact of negative factors of market economy on the cause of higher education in China, which corrodes a large number of leading cadres and staff in colleges and universities, and damages the good social image of colleges and universities. It has greatly damaged the vital interests of teachers and students in colleges and universities and the masses of the people. This paper first defines the definition of commercial bribery in colleges and universities, and introduces the manifestations of commercial bribery in colleges and universities, analyzes the present situation of commercial bribery in colleges and universities in China and the existing problems of anti-commercial bribery in colleges and universities. Based on the experience of foreign universities against commercial bribery, this paper puts forward the countermeasures against commercial bribery in colleges and universities of our country in view of the problems existing in the anti-commercial bribery of our country's colleges and universities. Commercial bribery in colleges and universities in China presents a relatively fixed field of involvement. Covert bribery leads to the difficulty of investigation and collection of evidence, the ways of bribery are more diversified, and the characteristics of collectivization of bribe-taking personnel in colleges and universities. Commercial bribery in colleges and universities in China is mainly concentrated in four fields: enrollment field, material procurement field, capital construction field and the field of university logistics industry. At present, there are some problems in the work of anti-commercial bribery in colleges and universities in our country. In the legal system, there has not been a perfect and standardized system of anti-commercial bribery laws and regulations, and the light punishment in judicial punishment has little effect on the warning and punishment of criminal personnel. The work of anti-commercial bribery in colleges and universities in our country is a complicated systematic project. We should take several measures on the basis of drawing lessons from the relevant experience of anti-commercial bribery at home and abroad. We should perfect the construction of legal system, make it dare not to commit crimes; promote the university to deadministrate, make it not easy to commit crimes; strengthen the supervision mechanism of colleges and universities, make it impossible to commit crimes.
