我國(guó)網(wǎng)絡(luò)廣告法律規(guī)制研究

【摘要】:網(wǎng)絡(luò)廣告伴隨網(wǎng)絡(luò)科技及商務(wù)技術(shù)發(fā)展不斷更新。但是其在促進(jìn)網(wǎng)絡(luò)經(jīng)濟(jì)飛速發(fā)展同時(shí)也沖擊了我國(guó)現(xiàn)行廣告法律制度。因而深入分析研究網(wǎng)絡(luò)廣告法律規(guī)制問(wèn)題對(duì)于適應(yīng)時(shí)代發(fā)展,維護(hù)網(wǎng)絡(luò)經(jīng)濟(jì)穩(wěn)定,規(guī)范廣告行業(yè)秩序具有著重要意義。本文通過(guò)四個(gè)部分對(duì)網(wǎng)絡(luò)廣告中法律問(wèn)題分析研究。第一部通過(guò)論述網(wǎng)絡(luò)廣告基本理論,明確網(wǎng)絡(luò)廣告認(rèn)知,為網(wǎng)絡(luò)廣告法律規(guī)制研究提供理論基礎(chǔ)。第二部通過(guò)對(duì)我國(guó)網(wǎng)絡(luò)廣告規(guī)制中存在網(wǎng)絡(luò)主體界定不清,網(wǎng)絡(luò)內(nèi)容審查和監(jiān)管不到位,相關(guān)規(guī)制法律不健全,消費(fèi)者監(jiān)督作用和行業(yè)自律規(guī)范作用未能有效發(fā)揮等法律問(wèn)題進(jìn)行深入研究分析發(fā)掘其產(chǎn)生原因。第三部分對(duì)域外網(wǎng)絡(luò)廣告法律規(guī)制分析,了解域外規(guī)制情況,總結(jié)和分析各國(guó)在這方面值得借鑒的成熟方法。第四部分對(duì)我國(guó)網(wǎng)絡(luò)廣告發(fā)展現(xiàn)狀和規(guī)制情況分析,并結(jié)合域外法律規(guī)制中有益之處為完善我國(guó)網(wǎng)絡(luò)廣告法律規(guī)制提供幾點(diǎn)建議。全文通過(guò)對(duì)于網(wǎng)絡(luò)廣告法律規(guī)制問(wèn)題進(jìn)行深入分析研究,并結(jié)合域外先進(jìn)理論與實(shí)踐經(jīng)驗(yàn)分析,從而提出盡可能具體的規(guī)制建議,使網(wǎng)絡(luò)廣告參與者在市場(chǎng)經(jīng)濟(jì)范圍內(nèi)有效發(fā)揮自身作用以促進(jìn)網(wǎng)絡(luò)廣告法律規(guī)制體系建立,使之有益網(wǎng)絡(luò)廣告行業(yè)發(fā)展,有益網(wǎng)絡(luò)經(jīng)濟(jì)秩序穩(wěn)定。
[Abstract]:With the development of network technology and commerce technology, network advertisement is constantly updated.However, it promotes the rapid development of the network economy and also impacts the current advertising legal system of our country.Therefore, it is of great significance to analyze and study the legal regulation of online advertising for adapting to the development of the times, maintaining the stability of the network economy and standardizing the order of the advertising industry.This paper analyzes the legal problems in online advertising through four parts.The first part, through discussing the basic theory of network advertisement, clarifies the cognition of network advertisement, and provides the theoretical basis for the study of legal regulation of network advertisement.In the second part, the definition of network subject is not clear, the examination and supervision of network content is not in place, and the relevant regulation law is not perfect.The legal problems, such as consumer supervision and industry self-regulation, can not be effectively brought into play.The third part analyzes the legal regulation of the extraterritorial network advertising, understand the situation of the extraterritorial regulation, and summarize and analyze the mature methods that countries can use for reference in this respect.The fourth part analyzes the current situation of the development and regulation of China's network advertising, and provides some suggestions for perfecting the legal regulation of the network advertising in our country in combination with the advantages of the extraterritorial legal regulation.Through the deep analysis and research on the legal regulation of network advertisement, and combining with the advanced theory and practical experience of foreign countries, the paper puts forward some suggestions for regulation as much as possible.In order to promote the establishment of the legal regulation system of network advertisement, it is beneficial to the development of network advertising industry and the stability of network economy order to make the participants of network advertisement play their role effectively within the scope of market economy.
