【摘要】:隨著網(wǎng)絡(luò)技術(shù)的日益發(fā)展和互聯(lián)網(wǎng)的日益普及,網(wǎng)絡(luò)購物由于其相對(duì)傳統(tǒng)購物而言價(jià)格的低廉、種類的全面以及購買途徑的便捷而成為愈來愈多消費(fèi)者的選擇。除了給傳統(tǒng)線下購物帶來巨大沖擊之外,由于網(wǎng)絡(luò)購物而滋生的問題也層出不窮。2016年天貓“雙11”總成交額為1207億元人民幣,這個(gè)令人咋舌的數(shù)字背后隱藏的諸多問題值得探究。其中,電商價(jià)格欺詐是其中凸顯的重要問題之一,這其實(shí)是一個(gè)老生常談的問題。發(fā)改委價(jià)格監(jiān)督局早在2015年發(fā)布的《關(guān)于規(guī)范網(wǎng)絡(luò)零售價(jià)格行為的提醒書》中就明確了在“雙11”期間將嚴(yán)查價(jià)格欺詐,規(guī)范商品的價(jià)格行為,但網(wǎng)絡(luò)購物價(jià)格欺詐行為仍然難以杜絕。關(guān)于電商價(jià)格欺詐的丑聞屢屢被曝,而商家卻“屢教不改”,究其原因,除對(duì)于網(wǎng)絡(luò)購物價(jià)格欺詐行為的規(guī)制不足以及監(jiān)管缺位之外,相關(guān)部門對(duì)于電商價(jià)格欺詐行為處罰力度過輕也是重要原因。對(duì)于違法商家,其處罰往往只是罰酒三杯,與違法所帶來的利益相比,罰款只是九牛一毛,不痛不癢,缺乏威懾力。網(wǎng)絡(luò)購物價(jià)格欺詐隨著電商產(chǎn)業(yè)的發(fā)展也日趨復(fù)雜,在法律規(guī)制不完善的情況下,維護(hù)消費(fèi)者、同業(yè)合法競(jìng)爭者以及其他主體的利益也較為困難。本文先從兩個(gè)關(guān)于網(wǎng)絡(luò)購物價(jià)格欺詐的經(jīng)典案例入手,引出論題,接著對(duì)于網(wǎng)絡(luò)購物價(jià)格欺詐的概念、內(nèi)涵以及外延進(jìn)行了理論上的分析,與傳統(tǒng)價(jià)格欺詐進(jìn)行區(qū)分,并繼續(xù)對(duì)于網(wǎng)絡(luò)購物價(jià)格欺詐行為的表現(xiàn)形式進(jìn)行了淺析,并簡述了其成因,這是本文的理論出發(fā)點(diǎn)。接著,聯(lián)系我國法律規(guī)制現(xiàn)狀,包括在消費(fèi)者權(quán)益保護(hù)法、電子商務(wù)法、價(jià)格法、反不正當(dāng)競(jìng)爭法上的規(guī)制,結(jié)合國外對(duì)網(wǎng)絡(luò)購物價(jià)格欺詐規(guī)制以及監(jiān)管之先進(jìn)經(jīng)驗(yàn),最終總結(jié)提出可供我國參考之處。最后,淺述了一些本文關(guān)于完善網(wǎng)絡(luò)購物價(jià)格欺詐行為法律規(guī)制之思考。本文立足于經(jīng)濟(jì)法學(xué)理論基礎(chǔ),從社會(huì)現(xiàn)實(shí)出發(fā),將真實(shí)案例作為切入點(diǎn),結(jié)合國內(nèi)現(xiàn)實(shí),分析和界定了網(wǎng)絡(luò)購物價(jià)格欺詐行為本身及其相關(guān)法律規(guī)制。本文采取了案例分析方法、比較分析方法、法律規(guī)范研究方法以及舉例說明分析方法對(duì)此進(jìn)行分析,重點(diǎn)是解決相關(guān)問題,最終得到針對(duì)該問題的相關(guān)建議。
[Abstract]:With the development of the network technology and the popularization of the Internet, the online shopping has become the choice of more and more consumers because of its low price compared with the traditional shopping, comprehensive variety and convenient way to purchase.In addition to the huge impact on traditional offline shopping, problems arising from online shopping have sprung up in endlessly. Tmall's total turnover for "Shuang11" in 2016 was 120.7 billion yuan.Many of the problems behind this breathtaking number are worth exploring.Among them, e-commerce price fraud is one of the prominent important issues, which is a clich 茅.As early as 2015, the Price Supervision Bureau of the NDRC issued a reminder on standardizing the behavior of online retail prices, which made it clear that during the "double 11" period, it would strictly investigate price fraud and standardize the price behavior of commodities.But online shopping price fraud is still difficult to eliminate.The scandal about e-commerce price fraud has been exposed time and again, but the merchants have not changed. The reason is that, in addition to the inadequate regulation of online price fraud and the absence of supervision,The relevant department for e-commerce price fraud punishment is also an important reason.For illegal businesses, the penalty is often only three glasses of wine, compared with the benefits brought by the law, the fine is nothing, not itching, lack of deterrence.With the development of e-commerce industry, online shopping price fraud is becoming more and more complex. It is difficult to protect the interests of consumers, legitimate competitors and other subjects in the situation of imperfect legal regulation.This paper starts with two classic cases of online shopping price fraud, and then analyzes the concept, connotation and extension of online shopping price fraud in theory, and distinguishes it from traditional price fraud.And continue to analyze the form of online shopping price fraud, and briefly explain its causes, which is the theoretical starting point of this paper.Then, according to the current situation of legal regulation in China, including consumer rights and interests protection law, electronic commerce law, price law, anti-unfair competition law regulation, combined with foreign online shopping price fraud regulation and supervision of advanced experience.Finally, the paper puts forward some references for our country.Finally, some thoughts about perfecting the legal regulation of online shopping price fraud are discussed in this paper.Based on the theory of economic law, this paper analyzes and defines the online shopping price fraud itself and its related legal regulations, taking the real case as the starting point and combining the domestic reality.This paper adopts the case analysis method, the comparative analysis method, the law norm research method and the example explanation analysis method to carry on the analysis to this, the emphasis is to solve the related question, finally obtains the related suggestion to this question.
