【摘要】：虛假?gòu)V告的普遍存在對(duì)消費(fèi)者、其他經(jīng)營(yíng)者、媒體公信力帶來(lái)了極大的負(fù)面影響,也給市場(chǎng)經(jīng)濟(jì)的健康運(yùn)行造成嚴(yán)重危害。對(duì)虛假?gòu)V告進(jìn)行法律規(guī)制已經(jīng)成為一種重要的治理手段我國(guó)制定頒布的《廣告法》、《消費(fèi)者權(quán)益保護(hù)法》以及《反不正當(dāng)競(jìng)爭(zhēng)法》都在一定程度上為解決虛假?gòu)V告問(wèn)題提供了途徑。值得注意的是《廣告法修訂草案二次審議稿》對(duì)虛假?gòu)V告的概念及其表現(xiàn)形式做出明確規(guī)定,并強(qiáng)化了虛假?gòu)V告相關(guān)主體的法律責(zé)任,可以期待修訂后的《廣告法》對(duì)虛假?gòu)V告的規(guī)制將有明顯改善。但不可否認(rèn)的是,既有的法律規(guī)制途徑都比較注重行政處罰手段,其對(duì)虛假?gòu)V告相關(guān)主體的事后懲戒可能起到一定的作用,但在如何防范虛假?gòu)V告的產(chǎn)生以及如何影響相關(guān)主體的事前決策方面仍然存在局限。這也提醒我們有必要從一個(gè)新的角度去看待虛假?gòu)V告治理問(wèn)題。本文在分析虛假?gòu)V告一般治理途徑不足的基礎(chǔ)上,引入信息規(guī)制手段,提出強(qiáng)化虛假?gòu)V告治理中信息規(guī)制的法律對(duì)策。本文除引言和結(jié)語(yǔ)之外主要分為四部分:第一部分是虛假?gòu)V告信息規(guī)制的一般概述,闡述虛假?gòu)V告的界定和認(rèn)定標(biāo)準(zhǔn)、虛假?gòu)V告治理的一般途徑及其不足,強(qiáng)調(diào)信息規(guī)制在虛假?gòu)V告治理中的作用。第二部分主要分析信息規(guī)制在虛假?gòu)V告治理中的運(yùn)用,并從不同方面分析信息規(guī)制實(shí)踐中亟待解決的問(wèn)題。第三部分著重介紹國(guó)外在虛假?gòu)V告治理中運(yùn)用信息規(guī)制的基本狀況,總結(jié)出適合我國(guó)借鑒的有益經(jīng)驗(yàn)。第四部分提出完善我國(guó)虛假?gòu)V告治理中信息規(guī)制的法律對(duì)策。這部分是全文重點(diǎn),主要從完善虛假?gòu)V告治理中信息規(guī)制的法律體系、構(gòu)建系統(tǒng)的誠(chéng)信檔案制度、引入更正廣告制度、完善有獎(jiǎng)舉報(bào)制度、完善消費(fèi)警示制度方面加以闡述。
[Abstract]:The widespread existence of false advertising has brought great negative effects on consumers, other operators and media credibility, and has also caused serious harm to the healthy operation of the market economy.Legal regulation of false advertising has become an important means of governance in China enacted and promulgated the "Advertising Law", "Consumer Rights and interests Protection Law" and "Anti-unfair Competition Law" to a certain extent to solve the problem of false advertisingThe problem provides an avenue.It is worth noting that the second Review of the revised draft of the Advertising Law clearly stipulates the concept of false advertising and its forms of expression, and strengthens the legal responsibility of the subjects concerned with false advertisements.We can expect that the regulation of false advertising will be improved obviously.However, there is no denying that the existing ways of legal regulation pay more attention to administrative punishment, which may play a certain role in the subsequent punishment of the subjects concerned with false advertisements.However, there are still limitations in how to prevent false advertising and how to influence the prior decision of relevant subjects.This also reminds us that it is necessary to look at the problem of false advertising governance from a new perspective.Based on the analysis of the deficiency of the general governance approach of false advertising, this paper introduces the means of information regulation and puts forward the legal countermeasures to strengthen the information regulation in the governance of false advertising.In addition to the introduction and conclusion, this paper is mainly divided into four parts: the first part is a general overview of the regulation of false advertising information, the definition and identification of false advertising standards, the general approach to the governance of false advertising and its shortcomings.Emphasis on the role of information regulation in false advertising governance.The second part mainly analyzes the application of information regulation in the management of false advertising, and analyzes the problems to be solved in the practice of information regulation from different aspects.The third part mainly introduces the basic situation of using information regulation in foreign countries in the management of false advertisement, and sums up the beneficial experience which is suitable for our country to use for reference.The fourth part puts forward the legal countermeasures to perfect the information regulation in the management of false advertisement in our country.This part is the focus of the paper, mainly from the aspects of perfecting the legal system of information regulation in the management of false advertisement, constructing the system of honest archives, introducing the system of correcting advertisement, perfecting the system of reporting with awards, and perfecting the warning system of consumption.
