【摘要】：中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)(以下簡(jiǎn)稱上海自貿(mào)試驗(yàn)區(qū))是我國(guó)(論文所言我國(guó)皆指我國(guó)內(nèi)地地區(qū))建立第一個(gè)與國(guó)際水平相接軌的自貿(mào)區(qū)(論文所言自貿(mào)區(qū)皆指境內(nèi)單邊的自貿(mào)區(qū)),它的建立與目前我國(guó)對(duì)經(jīng)濟(jì)發(fā)展與對(duì)外開(kāi)放的要求相符合,有利于推動(dòng)我國(guó)經(jīng)濟(jì)的發(fā)展,帶動(dòng)我國(guó)經(jīng)濟(jì)的轉(zhuǎn)型升級(jí),進(jìn)一步擴(kuò)大我國(guó)對(duì)外開(kāi)放,它的建立也開(kāi)啟了我國(guó)內(nèi)地其他自貿(mào)區(qū)的建設(shè)之路,而法律保障制度的建設(shè)將為上海自貿(mào)試驗(yàn)區(qū)的正常運(yùn)行與發(fā)展提供有力保障,同時(shí)也將為已經(jīng)在廣東、福建、天津建立起來(lái)的自貿(mào)試驗(yàn)區(qū)及未來(lái)我國(guó)要建立的其它自貿(mào)區(qū)的法律保障制度建設(shè)提供模式可循。本文共分三個(gè)部分,第一部分主要是對(duì)上海自貿(mào)試驗(yàn)區(qū)的建立背景、過(guò)程及其類型與功能定位進(jìn)行闡述,第二部分作為本文論述的重點(diǎn)部分,在對(duì)上海自貿(mào)試驗(yàn)區(qū)現(xiàn)行法律保障制度主要內(nèi)容進(jìn)行介紹的基礎(chǔ)上,針對(duì)其創(chuàng)新之處及尚需完善之處給予比較詳盡的論述。第三部分主要是對(duì)完善上海自貿(mào)試驗(yàn)區(qū)現(xiàn)行法律保障制度提出淺顯的思考與建議。上海自貿(mào)試驗(yàn)區(qū)法律保障制度的建設(shè)將具有很強(qiáng)的示范作用,所以對(duì)其進(jìn)行研究無(wú)論從理論還是從實(shí)踐上都具有重要意義,這也正是本文的寫作價(jià)值所在。
[Abstract]:China (Shanghai) Free Trade Test area (hereinafter referred to as Shanghai Free Trade Test area) is the first free trade area (FTAZ) to be established in China (referred to in the paper). Both refer to unilateral domestic free trade zones, which are in line with China's current requirements for economic development and opening to the outside world. It is conducive to promoting the development of our economy, promoting the transformation and upgrading of our economy, and further expanding our opening to the outside world. Its establishment has also opened the way for the construction of other free trade zones in the mainland of China. The construction of the legal protection system will provide strong protection for the normal operation and development of the Shanghai Free Trade Test Zone, and will also provide a guarantee for the normal operation and development of the Shanghai Free Trade Test Zone, as well as for those already in Guangdong and Fujian. The free trade experimental zone established in Tianjin and the other free trade zones to be established in China in the future can follow the model of legal guarantee system construction. This paper is divided into three parts. The first part is the background of the establishment of Shanghai free trade test area. The second part, as the key part of this paper, introduces the main contents of the current legal protection system of Shanghai Free Trade Test area. The third part is to put forward some simple thoughts and suggestions to perfect the current legal protection system of Shanghai Free Trade Test area. The construction of barrier system will have a strong demonstration function, Therefore, it is of great significance to study it both theoretically and practically, which is the value of this paper.
