【摘要】:隨著改革開放以來社會(huì)財(cái)富的不斷累積,中國(guó)私人銀行業(yè)務(wù)發(fā)展迅猛。但是作為新興業(yè)務(wù)的私人銀行業(yè)務(wù)在我國(guó)正處于起步發(fā)展的階段,國(guó)內(nèi)法律對(duì)私人銀行業(yè)務(wù)的規(guī)制還不夠完善,其中客戶信息保護(hù)的法律問題尤為突出。本文通過對(duì)私人銀行業(yè)務(wù)中與客戶信息保護(hù)有關(guān)的理論進(jìn)行分析,對(duì)比考察國(guó)外先進(jìn)的法律制度,指出我國(guó)在私人銀行業(yè)務(wù)客戶信息保護(hù)存在的主要問題,最后對(duì)我國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)制度提出的完善建議。本文從四個(gè)部分對(duì)私人銀行業(yè)務(wù)客戶信息保護(hù)的法律問題進(jìn)行探討。第一部分主要對(duì)我國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)的基本理論進(jìn)行闡述。首先從私人銀行業(yè)務(wù)的定義、特征、法律關(guān)系三方面對(duì)私人銀行業(yè)務(wù)進(jìn)行理論分析并且對(duì)私人銀行業(yè)務(wù)中客戶信息的定義作出界定,最后闡述了私人銀行業(yè)務(wù)客戶信息保護(hù)的必要性與可行性。第二部分主要對(duì)比分析歐盟與美國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)的法律制度,通過對(duì)外國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)制度的考察,闡述域外法律制度對(duì)我國(guó)完善私人銀行業(yè)務(wù)客戶信息保護(hù)法律制度的啟示。第三部分主要分析我國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)存在的問題,主要包括私人銀行業(yè)務(wù)客戶信息保護(hù)缺乏系統(tǒng)性與操作性,私人銀行業(yè)務(wù)客戶信息保護(hù)在征信程序上遭遇現(xiàn)實(shí)的困境等。然后對(duì)我國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)問題存在的原因進(jìn)行分析與探討。第四部分主要對(duì)完善我國(guó)私人銀行業(yè)務(wù)客戶信息保護(hù)制度提出建議。首先是針對(duì)客戶信息保護(hù)缺乏系統(tǒng)性的問題,建議通過提高客戶信息保護(hù)的法律地位以及制訂統(tǒng)一的私人銀行業(yè)務(wù)客戶信息保護(hù)的基本法律加以完善。其次是針對(duì)客戶信息保護(hù)缺乏操作性的問題,在客戶主體權(quán)利、客戶信息保護(hù)法律責(zé)任、客戶信息保護(hù)例外規(guī)定三個(gè)方面提出完善的建議。最后通過在征信程序中確立信息公開原則以及在法律上規(guī)范征信程序的建議緩解私人銀行業(yè)務(wù)客戶信息保護(hù)在征信程序中遭遇的現(xiàn)實(shí)困境。
[Abstract]:With the continuous accumulation of social wealth since the reform and opening up, China's private banking business has developed rapidly.However, as a new business, the private banking business is in the initial stage of development in China, the regulation of private banking business in domestic law is not perfect, among which, the legal problem of customer information protection is particularly prominent.Based on the analysis of the theories related to customer information protection in the private banking business, this paper compares the advanced legal systems abroad, and points out the main problems existing in the protection of customer information in the private banking business in China.Finally, the author puts forward some suggestions to improve the customer information protection system of private banking in China.This paper discusses the legal issues of customer information protection in private banking from four parts.The first part mainly expounds the basic theory of customer information protection of private banking in China.First of all, it makes a theoretical analysis of private banking business from the definition, characteristics and legal relationship of private banking business and defines the definition of customer information in private banking business.Finally, the necessity and feasibility of customer information protection in private banking are expounded.The second part mainly compares and analyzes the legal system of customer information protection between European Union and American private banking business, through the investigation of foreign private bank business customer information protection system.This paper expounds the enlightenment of the extraterritorial legal system on perfecting the legal system of customer information protection of private banking in China.The third part mainly analyzes the problems existing in customer information protection of private banking business in China, including the lack of systematicness and maneuverability of customer information protection in private banking business.Private banking customer information protection in the credit process encountered practical difficulties.Then it analyzes and discusses the reasons of customer information protection problem in private banking in China.The fourth part puts forward some suggestions to improve the customer information protection system of private banking in China.First of all, aiming at the lack of systematic customer information protection, it is suggested to improve the legal status of customer information protection and formulate a unified basic law for customer information protection in private banking business.Secondly, aiming at the lack of operability of customer information protection, the author puts forward some perfect suggestions in three aspects: the rights of client subject, the legal responsibility of customer information protection and the exception of customer information protection.Finally, by establishing the principle of information disclosure in the procedure of credit investigation and the suggestion of standardizing the procedure of credit reporting in law, we can alleviate the practical difficulties encountered in the process of customer information protection in the private banking business.
