【摘要】：大型體育場(chǎng)館項(xiàng)目PPP融資是政府和社會(huì)資本合作支持我國(guó)大型體育場(chǎng)館項(xiàng)目的新興金融路徑,其不僅有利于破解"蒙特利爾陷阱",緩解政府的財(cái)政壓力,還能從根本上推動(dòng)政府職能轉(zhuǎn)變。建議在《體育法》中對(duì)大型體育場(chǎng)館項(xiàng)目適用PPP融資做出原則性的規(guī)定,并制定《政府與社會(huì)資本合作法》對(duì)PPP融資作頂層制度設(shè)計(jì),細(xì)化PPP融資的核心法律制度,加強(qiáng)對(duì)社會(huì)資本方權(quán)利的保護(hù)。同時(shí)改善大型體育場(chǎng)館PPP項(xiàng)目公司外部融資的法制環(huán)境,并建立相應(yīng)的綜合治理法律框架。
[Abstract]:PPP financing for large-scale stadiums and gymnasiums is a new financial path for the government and social capital to cooperate to support the large-scale stadiums and gymnasiums in China. It is not only conducive to breaking the "Montreal trap", but also easing the financial pressure of the government. It also can fundamentally promote the transformation of government functions. It is suggested that the "Sports Law" should make a principled provision on the application of PPP financing to large sports stadiums and gymnasiums, and formulate the "Government-Social Capital Cooperation Law" to design the top-level system for PPP financing. The core legal system of PPP financing should be refined, and the protection of the rights of social capital should be strengthened. At the same time, the legal environment for the external financing of large stadiums and gymnasiums and PPP project companies should be improved, and the corresponding legal framework for comprehensive management should be established.
