【摘要】：隨著資本主義經(jīng)濟(jì)的發(fā)展,社會(huì)經(jīng)濟(jì)水平得到了較大提高。在這種經(jīng)濟(jì)背景下,一方面人們?yōu)榱诉m應(yīng)社會(huì)發(fā)展的需要更加注重社會(huì)效率,另一方面各種領(lǐng)域都逐步轉(zhuǎn)向機(jī)械化生產(chǎn),人們面臨的危險(xiǎn)也逐步增多。這些改變使保險(xiǎn)領(lǐng)域自身受到了很大的影響,保險(xiǎn)行業(yè)加入了“改革”的行列。最明顯的變化就是保險(xiǎn)人為了提高效率,滿足越來(lái)越多投保人的需求,在保險(xiǎn)合同訂立之前預(yù)先擬定好合同,也就是我們現(xiàn)在所說(shuō)的格式合同。格式合同在保險(xiǎn)領(lǐng)域的正式應(yīng)用改變了傳統(tǒng)的訂立保險(xiǎn)合同的形式,投保人的利益較以前面臨更大的風(fēng)險(xiǎn)。為了避免保險(xiǎn)人利用其優(yōu)勢(shì)地位損害投保人的利益,保險(xiǎn)合理期待原則隨之產(chǎn)生。本篇論文通過(guò)對(duì)保險(xiǎn)合理期待原則內(nèi)涵、特征、適用條件以及合理期待判定的論述,闡明了保險(xiǎn)合理期待原則的價(jià)值。最后通過(guò)對(duì)我國(guó)保險(xiǎn)法立法及司法上存在的問(wèn)題進(jìn)行分析整理,總結(jié)出保險(xiǎn)合理期待原則對(duì)我國(guó)法律的參考價(jià)值并提出具體化建議。
[Abstract]:With the development of capitalist economy, the social and economic level has been greatly improved. In this economic background, on the one hand, people pay more attention to social efficiency in order to meet the needs of social development. On the other hand, with the gradual shift to mechanized production in various fields, people are facing increasing risks. These changes have greatly affected the insurance industry itself. The insurance industry has joined the ranks of "reform". The most obvious change is that insurers, in order to improve efficiency and meet the needs of more and more policy holders, draw up contracts in advance of the conclusion of insurance contracts. That is, what we now call format contracts. The formal application of format contracts in the field of insurance has changed the traditional form of concluding insurance contracts. In order to prevent the insurer from taking advantage of its advantage to damage the interests of the policyholder, the principle of reasonable expectation of insurance comes into being. This paper introduces the connotation and characteristics of the principle of reasonable expectation of insurance. This paper expounds the value of the principle of reasonable expectation of insurance by discussing the applicable conditions and the judgment of reasonable expectation. Finally, it analyzes and sorts out the problems existing in legislation and judicature of insurance law in our country. This paper summarizes the reference value of the principle of reasonable expectation of insurance to the law of our country and puts forward concrete suggestions.
