【摘要】:本文以我國法律對船舶碰撞責任主體的現(xiàn)有規(guī)定為基礎,從應然的角度,體系化地研究了船舶碰撞責任主體的問題。文章結合世界海運大國的相關立法例和司法實踐,運用立法比較,案例分析等方法,研究了我國船舶碰撞責任主體立法不完善所帶來的問題,并在此基礎上對我國相關立法提出完善建議。全文共分為四章,第一章是對于船舶碰撞責任主體問題的概述,介紹了船舶侵權與一般侵權的區(qū)別和聯(lián)系,突出了船舶碰撞侵權行為的特殊性并指出了我國船舶碰撞責任主體立法上存在的問題;第二章在比較法研究的基礎上,分析了船舶碰撞責任主體的判斷標準,根據(jù)導致船舶碰撞事故的原因的不同,分析了不同情形下判斷船舶碰撞責任主體所應遵循的不同標準和原則;第三章具體到不同的船舶法律關系主體上,根據(jù)第二章所確定的判斷船舶碰撞責任主體的標準,分析個別主體能否被認定為船舶碰撞責任主體以及被認定為船舶碰撞責任主體的具體情形;第四章在識別船舶碰撞責任主體的基礎上,進一步研究主體之間對于責任的分擔問題。在研究方法上,本文從多角度出發(fā),綜合運用立法比較,案例分析,邏輯推理等多種研究方法,一方面,借鑒了國內(nèi)外學者的優(yōu)秀研究成果,另一方面,在借鑒的基礎上,也表達了自已的觀點和態(tài)度。尤其是結合日新月異的海運實踐,探討了海運實踐對于船舶碰撞責任主體認定的影響。筆者認為,從我國法律對于船舶碰撞責任主體的規(guī)定來看,尚有很大的完善空間。本文通過對理論和實踐的研究,從多角度把握,以期為我國船舶碰撞責任主體制度提供完善思路。
[Abstract]:This paper is based on the existing provisions of Chinese law on the subject of ship collision liability, from the perspective of the ought to be. This paper systematically studies the subject of ship collision liability. Combining with the relevant legislation and judicial practice of the major maritime countries in the world, this paper applies the methods of legislative comparison and case analysis. This paper studies the problems caused by the imperfect legislation of the subject of ship collision liability in China, and on this basis puts forward some suggestions for the improvement of the relevant legislation of our country. The full text is divided into four chapters. The first chapter is an overview of the subject of ship collision liability, introducing the difference and relationship between ship tort and general tort. It highlights the particularity of the tort of ship collision and points out the problems existing in the legislation of the subject of ship collision liability in China. On the basis of comparative study, the second chapter analyzes the judgment standard of the main body of ship collision responsibility, according to the different causes of ship collision accident. The different standards and principles that should be followed in judging the subject of ship collision responsibility under different circumstances are analyzed. The third chapter concretely to the different ship legal relation subject, according to the second chapter determines the judgment ship collision responsibility main body standard. Whether the individual subject can be recognized as the subject of ship collision liability and the specific situation of being recognized as the subject of ship collision responsibility; Chapter 4th, on the basis of identifying the subject of ship collision responsibility, further studies the sharing of responsibility among the subjects. In the research method, this paper makes comprehensive use of legislative comparison and case study from various angles. Logic reasoning and other research methods, on the one hand, draw on the outstanding research results of domestic and foreign scholars, on the other hand, on the basis of reference. Also expressed their own views and attitudes, especially combined with the ever-changing practice of maritime transport, discussed the impact of maritime practice on the subject of ship collision responsibility. From the point of view of the provisions of Chinese law on the subject of ship collision liability, there is still a lot of room for improvement. This paper, through the study of theory and practice, grasps from many angles. In order to provide perfect train of thought for our country ship collision responsibility subject system.
