【摘要】：隨著招標(biāo)采購活動的日益普及,招標(biāo)已成為各行各業(yè)普遍使用的采購方式,但是招投標(biāo)活動中存在的合規(guī)性問題也不容忽視。除了主觀惡意違規(guī),有很多不合規(guī)的情況是由于相關(guān)方不熟悉法律法規(guī)導(dǎo)致的被動違規(guī)。本文從依法必須招標(biāo)這一角度切入,系統(tǒng)梳理了現(xiàn)有和招標(biāo)相關(guān)的法律體系對依法必須招標(biāo)項目的界定,旨在引導(dǎo)采購相關(guān)方準(zhǔn)確判斷應(yīng)該遵守的法律法規(guī),確保招標(biāo)采購活動的合規(guī)性。
[Abstract]:With the increasing popularity of bidding and procurement activities, bidding has been widely used in all walks of life, but the compliance problems in bidding activities cannot be ignored. In addition to the subjective malevolent violations, there are a lot of disagreements because the relevant parties are not familiar with the passive violation caused by the laws and regulations. From the perspective of law bidding, this paper systematically sorts out the existing legal system related to bidding, and defines the bidding items according to law, so as to guide relevant parties to accurately judge the laws and regulations that should be followed, and ensure the compliance of bidding activities.
