日本知識(shí)產(chǎn)權(quán)審判情況概要

【摘要】：正近幾年,隨著日本"知識(shí)產(chǎn)權(quán)立國(guó)"戰(zhàn)略的實(shí)施,日本采取了一系列加快知識(shí)產(chǎn)權(quán)創(chuàng)造、加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù)的措施,其中的一個(gè)重要方面是知識(shí)產(chǎn)權(quán)審判方面的改革。近幾年,日本在知識(shí)產(chǎn)權(quán)實(shí)體法、訴訟法和法院(裁判所)法方面都進(jìn)行了修改。下面將本人了解的日本知識(shí)產(chǎn)權(quán)審判方面的情況作一簡(jiǎn)要介紹,以期對(duì)做好我國(guó)知識(shí)產(chǎn)權(quán)審判工作有所裨益。一、日本審判制度和法院體系 日本實(shí)行三審終審制,對(duì)一審法院的判決不服,當(dāng)事人可以向二審法院"控訴",對(duì)二審法院的判決不服,當(dāng)事人可以向三審法院"上告","控訴"和"上告"一般并稱為"上訴"。 日本的法院體系主要包括最高法院、高等法院、地方
[Abstract]:In recent years, with the implementation of Japan's strategy of "establishing the country of intellectual property", Japan has adopted a series of measures to speed up the creation of intellectual property rights and strengthen the protection of intellectual property rights. One of the important aspects is the reform of intellectual property rights trial. In recent years, Japan has made amendments to the substantive law of intellectual property, the law of procedure and the law of the courts. The following will be a brief introduction of Japan's intellectual property trials, with a view to doing a good job in China's intellectual property trials. First, Japan's judicial system and court system are subject to the system of final adjudication of third instance. If Japan does not accept the judgment of the court of first instance, the parties concerned may "lodge a complaint" with the court of second instance, and the parties may "appeal" to the court of third instance for their disobedience to the judgment of the court of second instance. "Complaints" and "Proclamation" are commonly referred to as "appeals". Japan's court system consists mainly of the Supreme Court, the High Court, and the local courts.
