【摘要】：家庭暴力作為廣受關注的熱點問題,其危害不言而喻,不僅是對人權的侵犯,也會影響家庭和諧、社會安定。家庭暴力幾乎在世界上每一個國家都不同程度的存在著,很多國家都用專門的家庭暴力法來預防和制止家庭暴力。在《反家庭暴力法》出臺前,我國在防治家庭暴力立法方面處于被動狀態(tài),沒有關于家庭暴力的專門法律。關于家庭暴力的規(guī)定散見于《婚姻法》等法律和一些地方法規(guī)中,其中只有一些倡導性規(guī)定,沒有明確的防治措施,缺乏操作性和實用性,對家庭暴力的防治效果甚微�！吨腥A人民共和國反家庭暴力法》的出臺改變了這一現(xiàn)狀,為根本上預防和制止家庭暴力提供了較為完善且切實可行的法律依據(jù)。本文以《中華人民共和國反家庭暴力法》的出臺為切入點,對《中華人民共和國反家庭暴力法》進行了認真的研讀、分析。筆者認為該法雖然明確了家庭暴力的概念,但界定不夠精準,筆者從定義、行為類型、特征三方面進行分析,對家庭暴力的定義的完善提出了自己的觀點。在對該法的適用主體分析后,發(fā)現(xiàn)該法沒有指出適用主體的范圍,筆者列出了家庭成員、家庭成員以外共同生活的人這兩類主體的范圍。該法第三章、第四章介紹了家庭暴力的防治措施,筆者對該法中家庭暴力防治措施和其在實際應用中可能出現(xiàn)的情況進行分析,客觀評價其成就與不足,并提出改進意見。
[Abstract]:As a hot issue of concern, domestic violence is not only a violation of human rights, but also affects family harmony and social stability. Domestic violence exists in almost every country in the world, and many countries use special domestic violence law to prevent and stop domestic violence. Before the enactment of the Anti-domestic violence Law, our country is in a passive state in the prevention and control of domestic violence legislation, there is no special law on domestic violence. The provisions on domestic violence are scattered in laws such as the Marriage Act and in some local regulations, among which there are only some advocacy provisions, no clear prevention and treatment measures, and lack of operability and practicality, The enactment of the Anti-domestic violence Law of the people's Republic of China has changed this situation and provided a perfect and feasible legal basis for preventing and curbing domestic violence fundamentally. Based on the introduction of the Anti-domestic violence Law of the people's Republic of China, this paper makes a careful study and analysis of the Anti-domestic violence Law of the people's Republic of China. The author thinks that although the law clearly defines the concept of domestic violence, but the definition is not accurate enough, the author from the definition, behavior types, characteristics of three aspects of analysis, to improve the definition of domestic violence put forward their own point of view. After analyzing the applicable subject of the law, it is found that the law does not point out the scope of the applicable subject. The author lists the scope of the two main subjects: family members and people who live together outside the family members. Chapter three and chapter four introduce the prevention and cure measures of domestic violence. The author analyzes the prevention and cure measures of domestic violence in this law and the possible situation of its application in practice, objectively evaluates its achievements and shortcomings, and puts forward some suggestions for improvement.
