【摘要】：英國(guó)社會(huì)從20世紀(jì)70年代開(kāi)始,通過(guò)實(shí)施民事保護(hù)令等全新的法律措施,經(jīng)相關(guān)人申請(qǐng),法庭依法簽署互不妨害令、占有令、禁止騷擾令、兒童評(píng)估令、兒童緊急保護(hù)令,及時(shí)為受害人提供充分保護(hù),法律全面地介入和干預(yù)家庭暴力,取得了良好成效。借鑒英國(guó)經(jīng)驗(yàn),我國(guó)應(yīng)轉(zhuǎn)變觀念,革新相關(guān)法律制度,建立民事保護(hù)令制度及時(shí)保護(hù)受害人,為家庭暴力受害人設(shè)立社會(huì)干預(yù)機(jī)制,立法規(guī)范干預(yù)家庭暴力的程序,創(chuàng)設(shè)家庭暴力防治中心,總結(jié)家庭暴力案件發(fā)生的教訓(xùn)以完善相關(guān)制度,建立信息通報(bào)制度,保障每個(gè)家庭成員享有安全、文明的家庭生活環(huán)境。
[Abstract]:Since the 1970s, through the implementation of new legal measures such as civil protection orders, the courts have signed non-nuisance orders, possession orders, prohibition of harassment orders, child evaluation orders, and emergency child protection orders on the application of the relevant persons. In time to provide adequate protection for victims, legal intervention and intervention in domestic violence, has achieved good results. Drawing lessons from the British experience, China should change ideas, reform the relevant legal system, establish a civil protection order system to protect victims in a timely manner, set up a social intervention mechanism for victims of domestic violence, and legislate to regulate the procedure of intervention in domestic violence. To establish the prevention and cure center of domestic violence, summarize the lessons of domestic violence cases in order to perfect the relevant system, set up the information notification system, and guarantee every family member to enjoy a safe and civilized family living environment.
