【摘要】：隨著社會(huì)經(jīng)濟(jì)的高速發(fā)展,離婚案件越來(lái)越多也越來(lái)越復(fù)雜,雖然從性質(zhì)上講,此類(lèi)案件屬于民事案件范疇,需適用民事訴訟法,但與一般訴訟程序相比,有許多獨(dú)特之處。離婚訴訟解除的主要是夫妻間的身份關(guān)系,附帶還需要對(duì)分割夫妻共同財(cái)產(chǎn)以及確定未成年子女的直接撫養(yǎng)人等問(wèn)題進(jìn)行處理。我國(guó)民事訴訟法雖對(duì)其作了特殊規(guī)定,但面對(duì)案件的復(fù)雜性和多樣性,少量又簡(jiǎn)單的特別規(guī)定是遠(yuǎn)遠(yuǎn)不夠的。針對(duì)離婚訴訟糾紛,必須對(duì)其特色進(jìn)行分析,從整體上把握解決機(jī)制的特殊性,才能在審理中有效的維護(hù)離婚雙方及未成年子女的權(quán)益。本文立足于我國(guó)離婚訴訟的法律規(guī)定和司法實(shí)踐,對(duì)訴訟各階段進(jìn)行層層分析,對(duì)比國(guó)外離婚訴訟的特殊規(guī)定,分析我國(guó)離婚訴訟糾紛的特殊解決機(jī)制。本文的目的是希望通過(guò)對(duì)我國(guó)離婚訴訟現(xiàn)狀的介紹和分析,及對(duì)域外部分國(guó)家離婚訴訟現(xiàn)狀的介紹和認(rèn)識(shí),喚起大家對(duì)離婚訴訟的重視,關(guān)注離婚訴訟糾紛特殊解決機(jī)制,以求更有效保護(hù)夫妻雙方的合法權(quán)益,維護(hù)未成年子女的利益,妥善解決家庭內(nèi)的矛盾和糾紛,促進(jìn)和諧社會(huì)的建立。本文一共寫(xiě)了四個(gè)部分。在第一部分中,筆者列舉了四個(gè)一般民事訴訟案例和離婚訴訟案例,通過(guò)對(duì)比分析案例的不同之處,得出離婚訴訟是特殊的,其解決機(jī)制是特殊的。在第二部分,筆者從離婚訴訟的法律規(guī)定和司法實(shí)踐兩個(gè)方面展開(kāi),分析我國(guó)的離婚訴訟相關(guān)概況。第三部分研究了美國(guó)、日本、德國(guó)關(guān)于離婚訴訟的相關(guān)法律和制度,了解各國(guó)對(duì)離婚訴訟糾紛的特殊解決機(jī)制。結(jié)合前三部分,本文第四部分從價(jià)值取向、案件內(nèi)容、適用程序以及輔助性作用等方面探討了我國(guó)離婚訴訟糾紛解決機(jī)制的特殊性。
[Abstract]:With the rapid development of social economy, more and more divorce cases are becoming more and more complex. Although such cases belong to the category of civil cases by nature, they need to be applied to the civil procedure law, but compared with the general litigation procedure, there are many unique points. The dissolution of divorce proceedings is mainly about the identity relationship between husband and wife, and it also needs to deal with the division of the joint property of husband and wife and the determination of the direct dependant of minor children. Although the civil procedure law of our country has made the special stipulation to it, it is far from enough to face the complexity and diversity of the case. In order to effectively safeguard the rights and interests of divorce parties and minor children, it is necessary to analyze the characteristics of divorce litigation disputes and grasp the particularity of the settlement mechanism as a whole. Based on the legal provisions and judicial practice of divorce litigation in our country, this paper analyzes the various stages of the proceedings, compares the special provisions of the divorce proceedings abroad, and analyzes the special settlement mechanism of the disputes in the divorce proceedings in our country. The purpose of this paper is to introduce and analyze the present situation of divorce litigation in our country, and to introduce and understand the present situation of divorce proceedings in some foreign countries, so as to arouse people's attention to divorce proceedings and pay close attention to the special settlement mechanism of disputes in divorce proceedings. In order to more effectively protect the legitimate rights and interests of husband and wife, safeguard the interests of minor children, properly solve the contradictions and disputes within the family, promote the establishment of a harmonious society. There are four parts in this paper. In the first part, the author enumerates four general civil litigation cases and divorce litigation cases. By comparing and analyzing the differences of cases, the author draws a conclusion that divorce litigation is special and its solution mechanism is special. In the second part, the author analyzes the general situation of divorce litigation in our country from two aspects: legal regulation and judicial practice. The third part studies the relevant laws and systems of divorce litigation in the United States, Japan and Germany, and understands the special settlement mechanism of divorce litigation disputes in various countries. Combined with the first three parts, the fourth part of this paper discusses the particularity of the dispute resolution mechanism of divorce litigation in China from the aspects of value orientation, case content, applicable procedure and auxiliary role.
