【摘要】：夫妻同居為夫妻共同生活的基礎要件 ,不僅涉及到夫妻關系的維系 ,更關系到子女的撫養(yǎng)、老人的贍養(yǎng)等問題。各國立法中 ,在明確規(guī)定夫妻有同居共同生活義務的基礎上 ,對違反該義務的法律責任等問題 ,一般都進行了規(guī)范。我國現(xiàn)行立法對同居問題幾乎是一片空白。值此修訂《婚姻法》之際 ,在法律中設立夫妻同居義務之規(guī)范 ,并對違反該義務應承擔的責任以及分居等問題加以明確規(guī)定 ,才能使法律條文的內容和所調整的社會關系更加貼切。
[Abstract]:The cohabitation of husband and wife is the basic element of the couple's common life, which involves not only the maintenance of the relationship between husband and wife, but also the maintenance of the children, the maintenance of the elderly and so on. In the legislation of various countries, on the basis of clearly stipulating that husband and wife have the obligation to live together, the legal liability for violating this obligation is generally regulated. China's current legislation on cohabitation is almost a blank. On the occasion of the amendment of the Marriage Law, the regulations on the obligation of cohabitation between husband and wife have been established in the law, and the responsibilities to be assumed in breach of this obligation, as well as the problems of separation, have been clearly defined. In order to make the content of the legal provisions and adjusted social relations more appropriate.
