【摘要】：進(jìn)入21世紀(jì)之后,我國(guó)已經(jīng)將制訂一部統(tǒng)一的民法典的工作提上重要議事日程,民法的法典化為婚姻法的完善提供了很好的機(jī)會(huì),同時(shí)也再度引發(fā)了關(guān)于婚姻法立法定位的爭(zhēng)論�，F(xiàn)以我國(guó)民法典的制訂為契機(jī),總結(jié)在歷史的不同時(shí)期以及不同的法律體系中婚姻法與民法的關(guān)系,分析婚姻法與民法的區(qū)別與聯(lián)系,在此基礎(chǔ)上提出完善婚姻家庭制度的一些思考,以期對(duì)構(gòu)建我國(guó)健全的婚姻法體系有所裨益。
[Abstract]:After entering the 21st century, China has put the work of making a unified civil code on the agenda. The codification of the civil law provides a good opportunity for the perfection of the marriage law. At the same time, it also triggered a debate on the legislative position of marriage law. Taking the formulation of civil code of our country as the turning point, this paper summarizes the relationship between marriage law and civil law in different historical periods and different legal systems, and analyzes the difference and relation between marriage law and civil law. On this basis, the author puts forward some thoughts on how to perfect the marriage and family system in order to benefit the construction of a sound marriage law system in our country.
