【摘要】：非常法定夫妻財(cái)產(chǎn)制為法定夫妻財(cái)產(chǎn)制的形態(tài)之一,其立法目的在于保護(hù)夫妻各方的財(cái)產(chǎn)權(quán)益和保障家庭扶養(yǎng)職能的履行,同時(shí)維護(hù)交易安全與第三人利益。值此我國(guó)"民法典婚姻家庭編"編纂之際,基于非常法定夫妻財(cái)產(chǎn)制的立法功能與立法價(jià)值,為滿足我國(guó)部分夫妻在婚姻期間因特殊情況對(duì)實(shí)行非常法定夫妻財(cái)產(chǎn)制的需要,建議借鑒大陸法系國(guó)家和我國(guó)臺(tái)灣地區(qū)立法經(jīng)驗(yàn),從我國(guó)實(shí)際出發(fā),在"民法典婚姻家庭編"中設(shè)立非常法定夫妻財(cái)產(chǎn)制。
[Abstract]:The extraordinary legal marital property system is one of the forms of the legal matrimonial property system. Its legislative purpose is to protect the property rights and interests of the spouses and to ensure the performance of the family support function, and at the same time to safeguard the security of transactions and the interests of the third party. At the time of compilation of Marriage and Family Editing of Civil Code of our country, based on the legislative function and legislative value of extraordinary legal matrimonial property system, in order to meet the needs of some couples in our country to implement extraordinary legal matrimonial property system during marriage due to special circumstances. It is suggested that we should draw lessons from the legislative experience of civil law countries and Taiwan region and set up the system of extraordinary legal matrimonial property in the Marriage and Family Edition of the Civil Code from the point of view of the reality of our country.
