【摘要】：正 長期以來,我國婚姻立法注重對夫妻財(cái)產(chǎn)的靜態(tài)權(quán)屬的確認(rèn)和保護(hù),較少考慮夫妻財(cái)產(chǎn)關(guān)系的動(dòng)態(tài)變化,忽視對夫妻財(cái)產(chǎn)利益流轉(zhuǎn)過程中的調(diào)整,致使法院處理夫妻財(cái)產(chǎn)關(guān)系時(shí)缺乏明確具體的法律依據(jù)。隨著市場經(jīng)濟(jì)的發(fā)展,夫妻財(cái)產(chǎn)關(guān)系的動(dòng)態(tài)流轉(zhuǎn)日益增多,雖然婚姻法解釋(一)(二)及時(shí)出臺(tái),對夫妻在婚前和婚姻關(guān)系存續(xù)期間的債權(quán)債務(wù)認(rèn)定作了進(jìn)一步規(guī)定,在一定程度上為統(tǒng)一司法實(shí)踐尺度、明晰審判思路提供了有利保障,也更利于對善意第三方的權(quán)利保護(hù)。然而婚姻法及其解釋均未對夫妻債權(quán)債務(wù)的處理予以明確規(guī)定,因此對在夫妻關(guān)系存續(xù)期間
[Abstract]:For a long time, China's marriage legislation has paid attention to the recognition and protection of the static property rights of husband and wife property, less considered the dynamic changes of marital property relations, and ignored the adjustment in the process of transferring the interests of husband and wife property. As a result, courts deal with marital property relations lack of clear and specific legal basis. With the development of the market economy, the dynamic circulation of marital property relations is increasing day by day. Although the interpretation of the Marriage Law (1) (2) was introduced in time, the identification of the creditor's rights and debts of the husband and wife before marriage and during the marriage relationship is further stipulated. To a certain extent, it provides a favorable guarantee for the unification of judicial practice and the clarity of judicial thinking, and is more conducive to the protection of the rights of bona fide third parties. However, neither the Marriage Law nor its interpretation clearly regulates the treatment of the creditor's rights and liabilities of the husband and wife, and therefore during the existence of the relationship between husband and wife.
