【摘要】：隨著人們生活方式的多樣化,同居現(xiàn)象日益增多。近年來同居者之間發(fā)生的財產(chǎn)糾紛的處理也成為司法實踐中的一個難題。因此法律對同居關(guān)系尤其是同居財產(chǎn)關(guān)系進行規(guī)范和調(diào)整迫在眉睫。本文采取案例分析、比較研究等方法,從導入典型案例并提出問題入手,歸納和梳理了司法實踐中存在的同居關(guān)系財產(chǎn)糾紛的類型,重點對非婚同居和婚外同居兩種情形下的財產(chǎn)糾紛進行了較為細致深入的類型化研究。同時對域外立法和審判實踐進行考察并借鑒,提出同居期間財產(chǎn)的歸屬確定原則、區(qū)分彩禮與大額贈與分別進行規(guī)范、婚外同居關(guān)系的贈與與補償處理應當考量目的因素等具體建議,希望對我國立法與司法實踐有所裨益。
[Abstract]:With the diversification of people's way of life, the phenomenon of cohabitation is increasing day by day. In recent years, the settlement of property disputes among cohabitants has also become a difficult problem in judicial practice. Therefore, it is urgent for the law to regulate and adjust the cohabitation relationship, especially the cohabitation property relationship. This paper adopts the methods of case analysis and comparative study, starting with the introduction of typical cases and putting forward problems, summarizes and combs the types of property disputes existing in the judicial practice. This paper focuses on the property disputes under the two situations of non-marital cohabitation and extramarital cohabitation. At the same time, the foreign legislation and trial practice are investigated and used for reference, and the principle of ascertaining the ownership of property during cohabitation is put forward, which distinguishes betrothal gifts from large gifts. In order to benefit our country's legislation and judicial practice, we should consider some specific suggestions such as objective factors and so on in the treatment of gift and compensation of extramarital cohabitation relationship.
