【摘要】：男同性戀者的妻子作為異性戀者,多數(shù)在與男同性戀者結(jié)合的婚姻中飽受煎熬,她們中的絕大多數(shù)被欺騙進(jìn)入婚姻,面臨男同性戀者對(duì)其配偶權(quán)的侵害,身心受損卻因我國(guó)法律在同性戀問(wèn)題上的失語(yǔ)而導(dǎo)致其正當(dāng)權(quán)益得不到保護(hù)。雖然同妻法律地位不明,但其困境是法律所不應(yīng)該回避的。調(diào)整婚姻法相關(guān)制度,通過(guò)完善可撤銷婚姻和離婚損害賠償制度、在離婚案件中撫養(yǎng)權(quán)歸屬及財(cái)產(chǎn)分配問(wèn)題上的適度傾斜,全方位地加強(qiáng)對(duì)同妻的權(quán)利保護(hù),同時(shí)推動(dòng)涉同性戀權(quán)益的立法,促進(jìn)社會(huì)正確對(duì)待同性戀,才能幫助同妻擺脫困境。
[Abstract]:The wives of gay men, as heterosexuals, are mostly suffering from marriages with gay men. Most of them are deceived into marriage and face the violation of their spouse rights by gay men. The damage of body and mind is due to the aphasia of our country's law on homosexuality, which leads to the lack of protection of its legitimate rights and interests. Although the legal status of the same wife is unclear, but its plight should not be avoided by the law. By adjusting the relevant system of marriage law, perfecting the system of annulable marriage and compensation for divorce damages, appropriately tilting custody rights and property distribution in divorce cases, strengthening the protection of the rights of the same wife in all directions, At the same time, to promote gay rights legislation, to promote the correct treatment of homosexuality, in order to help the wife out of difficulties.
