【摘要】：《中華人民共和國(guó)反家庭暴力法》設(shè)立了人身安全保護(hù)令制度,我國(guó)的人身安全保護(hù)令制度與其他國(guó)家的人身保護(hù)令制度不同,僅指對(duì)家庭暴力行為采取行為保全措施的制度,是我國(guó)防治家庭暴力的新手段。此次人身安全保護(hù)令制度,從制度上對(duì)家庭暴力現(xiàn)象進(jìn)行了嚴(yán)格的規(guī)制,有利于從根本上保護(hù)受害人,進(jìn)一步推動(dòng)我國(guó)防治家庭暴力、保護(hù)人權(quán)的新發(fā)展。但是我國(guó)現(xiàn)行的人身安全保護(hù)令制度規(guī)定仍不完善,還存在許多不足,在實(shí)踐中體現(xiàn)出了一些與我國(guó)現(xiàn)實(shí)情況脫節(jié)的問(wèn)題,還需要進(jìn)一步完善。本文通過(guò)對(duì)《反家暴法》中人身安全保護(hù)令制度的評(píng)析,結(jié)合制度出臺(tái)一年以來(lái),人身安全保護(hù)令制度的實(shí)施現(xiàn)狀,總結(jié)該制度在實(shí)踐中產(chǎn)生的問(wèn)題,同時(shí)通過(guò)借鑒美國(guó)民事保護(hù)令制度的經(jīng)驗(yàn),提出對(duì)我國(guó)人身安全保護(hù)令制度的完善建議。
[Abstract]:The "Law of the people's Republic of China against domestic violence" establishes the system of personal security orders. The system of personal security orders in China is different from that of other countries, and refers only to the system of taking measures to preserve acts of domestic violence. It is a new method to prevent and cure domestic violence in our country. This system of personal security protection has strictly regulated the phenomenon of domestic violence, which is conducive to the fundamental protection of the victims, and further promotes the new development of preventing and controlling domestic violence and protecting human rights in our country. However, the current system of personal security protection in our country is still not perfect, there are still many deficiencies, in practice, there are some problems that are out of touch with the reality of our country, and need to be further improved. Based on the analysis of the system of personal security protection in the Anti-domestic violence Law and the current situation of the implementation of the system since the system was issued one year ago, this paper summarizes the problems arising from the system in practice. At the same time, by drawing lessons from the experience of the civil protection order system in the United States, the author puts forward some suggestions for the perfection of the personal security warrant system in our country.
