【摘要】： 從羅馬法設(shè)立監(jiān)護(hù)制度以來,許多國家都設(shè)立了以剝奪或限制被監(jiān)護(hù)人的決定權(quán)為保護(hù)手段的監(jiān)護(hù)制度,我國亦是如此。現(xiàn)代社會,保障人權(quán)的觀念已經(jīng)深入人心,出現(xiàn)了“對自我決定權(quán)的尊重”和“正�；睢�(normalization)的新思潮,在此影響下許多國家相繼修法,對本國的監(jiān)護(hù)制度進(jìn)行了改革,由接管式的監(jiān)護(hù)方式革新為維護(hù)被監(jiān)護(hù)人應(yīng)有自治地位的協(xié)助照護(hù)制度,被監(jiān)護(hù)人既有照護(hù)監(jiān)護(hù)人,又保留了自治權(quán)利,從而達(dá)到最有利于維護(hù)被監(jiān)護(hù)人的目的。根據(jù)聯(lián)合國劃分人口老齡化程度的標(biāo)準(zhǔn),我國已于1999年步入了老年型社會。我國的老年型社會具有老年人口規(guī)模大,人口老齡化速度快,經(jīng)濟(jì)相對不發(fā)達(dá)、未富先老,家庭養(yǎng)老功能弱化等特點(diǎn),這都是世界人口發(fā)展史上前所未有的。現(xiàn)代世界主要國家的成年人監(jiān)護(hù)制度中都已經(jīng)包含了老年人監(jiān)護(hù)制度的內(nèi)容,但我國的老年人監(jiān)護(hù)制度至今仍然是立法上的空白,我國現(xiàn)行的監(jiān)護(hù)制度由于存在諸多缺陷,立法理念上的滯后,立法內(nèi)容上的欠缺,不足以保護(hù)老年人的合法權(quán)益,導(dǎo)致無法有效應(yīng)對老齡化帶來的嚴(yán)峻挑戰(zhàn)。本文擬通過對國內(nèi)外老年人監(jiān)護(hù)的探討研究,提出了完善我國老年人監(jiān)護(hù)制度的建議,以期通過研究引起社會對老年人這一弱勢群體的關(guān)注,更好地維護(hù)他們的各項(xiàng)合法權(quán)益,達(dá)到法律保護(hù)與社會穩(wěn)定的平衡。
[Abstract]:Since the establishment of guardianship system in Roman law, many countries have set up guardianship system which takes deprivation or restriction of the right of decision of the guardian as the means of protection, and so does our country. In modern society, the concept of protecting human rights has been deeply rooted in people's hearts, and a new ideological trend of "respect for self-decision" and "normalization of life" has emerged. Under this influence, many countries have successively revised their laws and reformed their own guardianship systems. The reform of the way of taking over the guardianship is to maintain the assisted care system which should have the autonomy status of the guardian. The guardian has both the care guardian and the autonomous right, so as to achieve the purpose that is most beneficial to the maintenance of the guardian. According to the United Nations criteria for determining the degree of population aging, China has stepped into an aging society in 1999. The aging society of our country has the characteristics of large scale of aged population, rapid aging of population, relatively underdeveloped economy, old before becoming rich, weakening of family pension function, and so on, which are unprecedented in the history of world population development. The adult guardianship system of the main countries in the modern world has already included the content of the elderly guardianship system, but the system of the elderly guardianship system in our country is still a blank in the legislation up to now, the current guardianship system of our country has many defects because of many defects. The lag of legislative idea and the lack of legislative content are not enough to protect the legal rights and interests of the elderly, which leads to the inability to effectively deal with the severe challenges brought by the aging. In this paper, the author puts forward some suggestions on how to perfect the guardianship system of the elderly at home and abroad, in order to arouse the attention of the society to the vulnerable group of the elderly, and to better safeguard their legal rights and interests.
