【摘要】：夫妻財(cái)產(chǎn)制是我國(guó)《婚姻法》中的一項(xiàng)重要制度,它對(duì)于構(gòu)建和諧的家庭關(guān)系,維護(hù)個(gè)人財(cái)產(chǎn)權(quán)益起著重要作用。在司法實(shí)踐中因夫妻財(cái)產(chǎn)問(wèn)題產(chǎn)生的糾紛較多,究其原因主要在于法律規(guī)定不明晰,至今仍存在許多缺陷,如對(duì)夫妻共同財(cái)產(chǎn)的范圍規(guī)定得不周延,夫妻對(duì)共同財(cái)產(chǎn)的平等處分權(quán)尚缺少應(yīng)有的具體法律保障等。因此,在立法方面,應(yīng)從我國(guó)實(shí)際出發(fā),借鑒國(guó)外立法經(jīng)驗(yàn),進(jìn)一步明確夫妻共同財(cái)產(chǎn)的范圍,增設(shè)共同財(cái)產(chǎn)的管理制度,增加分別財(cái)產(chǎn)制度,增補(bǔ)夫妻約定財(cái)產(chǎn)制的具體內(nèi)容,建立約定財(cái)產(chǎn)登記制度,明確夫妻一方特有財(cái)產(chǎn)的種類和范圍,構(gòu)筑我國(guó)夫妻財(cái)產(chǎn)制的完整體系。
[Abstract]:Husband and wife property system is an important system in Marriage Law of our country. It plays an important role in building harmonious family relationship and safeguarding personal property rights and interests. In the judicial practice, there are many disputes arising from the property problems of husband and wife. The main reason is that the legal provisions are not clear and there are still many defects, such as the limited scope of the common property of husband and wife. The equal disposition right of husband and wife to the common property lacks the concrete legal guarantee and so on. Therefore, in the legislative aspect, we should proceed from the reality of our country, draw lessons from the foreign legislative experience, further clarify the scope of the common property of husband and wife, add the management system of the common property, increase the separate property system. It is necessary to supplement the specific contents of the property system of husband and wife, to establish the registration system of the agreed property, to make clear the category and scope of the special property of one spouse, and to construct a complete system of marital property system in our country.
