【摘要】： 公共政策績效評價是政府績效評價的重要領域。與傳統(tǒng)評價不同,公共政策績效評價凸顯政策對公眾的服務屬性,強化了公眾滿意導向�；橐鍪羌彝サ幕A,家庭是社會的細胞。按照我國法律的規(guī)定,合法有效地婚姻必須在婚姻登記機關辦理登記才能受法律的保護。但受傳統(tǒng)習俗的影響,我國長期盛行儀式之結婚制度,人們重儀式而輕登記,導致了事實婚姻的存在,如果立法一味的否決事實婚姻的效力,則不利于保護弱者的權利。事實上,自1955年至今,我國已五次頒布及完善了婚姻登記相關條例,作為一項與公眾利益息息相關的法律政策,如何從績效的視角對其進行評價具有重要的理論和現(xiàn)實意義。 本文按照政策績效評價的理念、流程和價值取向,依據(jù)“政策是什么——政策怎么樣——如何完善政策”的邏輯思路,在介紹我國婚姻登記制度內(nèi)容、特點及其演變過程的基礎上,首先從理論邏輯的角度對此項政策進行了評析,尤其是對2003年修訂的《婚姻登記條例》的背景、內(nèi)容、程序進行了法律、文化、倫理方面的審視和反思;之后依據(jù)對東莞市婚姻登記當事人的抽樣調(diào)查結果,從政策服務者的視角,較為全面了解和判斷婚姻當事人對此項政策的評價、期望以及祈求。調(diào)查結果表明,公眾對現(xiàn)行婚姻登記制度總體評價較高(4.01分,5分制),但各項評價內(nèi)容,如保障性、有效性、傳統(tǒng)性和方便性等的得分存在差別。從政策需求的角度,此項政策改進有較大的空間。在理論邏輯評價及需求評價的基礎上,本文提出了進一步完善我國婚姻登記制度的思考和建議,包括完善婚姻程序制度(如婚姻公示、婚前財產(chǎn)公證等)和婚姻登記制度(如強化規(guī)范性,對事實婚姻立法,以契約精神和社會關懷來推進婚姻管理與服務等等)。 值得說明的是,嚴格來說,制度和政策是兩個不同的范疇,制度往往通過政策體現(xiàn)出來,但為尊重約成的提法(婚姻登記制度、條例等),又體現(xiàn)本文研究的范疇——公共政策績效評價,本文對制度與政策兩者的內(nèi)涵不做嚴格區(qū)分,大多情況下含義一致,甚至可以互換。
[Abstract]:Public policy performance evaluation is an important field of government performance evaluation.Different from the traditional evaluation, the performance evaluation of public policy highlights the service attribute of the policy to the public and strengthens the guidance of public satisfaction.Marriage is the foundation of the family, and the family is the cell of the society.According to the law of our country, the legal and effective marriage must be registered in the marriage registration office in order to be protected by the law.But under the influence of the traditional custom, the marriage system which is popular in our country for a long time, people pay more attention to the ceremony than the registration, which leads to the existence of the de facto marriage. If the legislation blindly negates the effect of the fact marriage, it will be unfavorable to the protection of the rights of the weak.In fact, since 1955, China has promulgated and perfected marriage registration regulations five times. As a legal policy closely related to the public interest, how to evaluate marriage registration from the perspective of performance has important theoretical and practical significance.According to the concept, process and value orientation of policy performance evaluation, this paper introduces the content of marriage registration system in China according to the logical thinking of "what is the policy-how to improve the policy".On the basis of its characteristics and its evolution, this paper analyzes the policy from the angle of theory and logic, especially the background, content and procedure of the revised Marriage Registration regulations in 2003.Then according to the sample survey results of the registered parties of marriage in Dongguan City, from the perspective of the policy server, the author comprehensively understands and judges the evaluation, expectation and petition of the marriage parties to this policy.The results show that the general evaluation of the current marriage registration system is higher than that of the public, but there are differences in the scores of various evaluation contents, such as security, effectiveness, tradition and convenience.From the point of view of policy demand, there is much room for improvement.On the basis of theoretical logical evaluation and needs evaluation, this paper puts forward some thoughts and suggestions to further improve the marriage registration system in China, including the perfection of marriage procedure system (such as marriage publicity, etc.)Civil notarization of premarital property) and marriage registration system (such as strengthening the norm, legislating on the fact marriage, promoting marriage management and service with the spirit of contract and social care, etc.It is worth noting that, strictly speaking, institutions and policies are two different categories. Institutions are often reflected through policies, but in order to respect the treaty (marriage registration system),Regulations and so on, also reflect the scope of this study-public policy performance evaluation, this article does not make a strict distinction between the connotation of system and policy, in most cases the meaning is the same, or even interchangeable.
