【摘要】：人類對暴力既有崇拜之情又有恐懼之感,一個約束公共場所暴力行為的機構(gòu)誕生了,但家庭成員間的暴力并沒有得到遏止。深受傳統(tǒng)思想的影響,女性從屬于男性的觀念被保留,衣食住行上依賴男性,家庭暴力的代際遺傳等原因?qū)е录彝ケ┝κ⑿��！斗醇彝ケ┝Ψā泛推渌嚓P(guān)法律法規(guī)從立法、執(zhí)法、司法和社會參與四方面,構(gòu)成了我國反家庭暴力法律體系。盡管如此,仍然有諸多不足之處,如法律對家庭暴力受害者的權(quán)利保障不充分、在訴訟中受暴者舉證困難、公安機關(guān)自由裁量權(quán)過于大以及社會組織面臨無權(quán)處理家庭暴力事件的困境等。美國在上世紀(jì)七十年代就已經(jīng)很重視反家庭暴力的相關(guān)立法活動,所以在一些制度設(shè)計上我們可以借鑒美國經(jīng)驗。在立法上,應(yīng)當(dāng)擴大家庭暴力法律制度的適用主體范圍并且將性暴力作為家暴形式之一,提高虐待罪的法定刑以修正“寬嚴(yán)倒錯”問題,賦予家庭暴力受害者在不離婚的情形下提出損害賠償請求的權(quán)利,建立國家監(jiān)護制度。在法的實施中,應(yīng)當(dāng)重新考量適用何種程序及其啟動方式、當(dāng)事人之間舉證責(zé)任的分配,明確公安機關(guān)在執(zhí)法中的責(zé)任并限制其自由裁量權(quán)。此外,應(yīng)當(dāng)充分調(diào)動社會組織發(fā)揮其優(yōu)勢,以制止家庭暴力的發(fā)生并有效化解家庭矛盾。
[Abstract]:Human beings have both a feeling of worship and a sense of fear about violence. An institution has been created to restrain violence in public places, but violence among family members has not been stopped. The idea that women are subordinate to men, the dependence of men on clothing, food, housing and transportation, the intergenerational inheritance of domestic violence, etc., has led to the prevalence of domestic violence. The Anti-domestic violence Act and other relevant laws and regulations are legislated, enforced, and enforced. The four aspects of judicial and social participation constitute the legal system against domestic violence in our country. However, there are still many shortcomings, such as inadequate protection of the rights of victims of domestic violence in the law, and difficulties for those who are subjected to violence in litigation. The public security organs have too much discretion and social organizations are faced with the dilemma of not having the right to deal with domestic violence incidents. In -30s, the United States has already attached great importance to anti-domestic violence related legislative activities. So we can learn from the experience of the United States in the design of some systems. In legislation, we should expand the scope of application of the domestic violence legal system and regard sexual violence as one of the forms of domestic violence. To increase the legal penalties for the crime of ill-treatment in order to correct the problem of "leniency and strictness", to give victims of domestic violence the right to file claims for damages without divorce, and to establish a national guardianship system... in the implementation of the law, The procedure to be applied and the manner in which it should be initiated, the distribution of the burden of proof among the parties, the responsibility of public security organs in law enforcement and the limitation of their discretion should be reconsidered. In addition, social organizations should be fully mobilized to bring their advantages into full play, In order to stop the occurrence of domestic violence and effectively resolve family conflicts.
