【摘要】：探望權(quán)入法至今已16年,但是對(duì)于是否應(yīng)擴(kuò)大探望權(quán)的主體范圍到目前依然沒(méi)有定論。在我國(guó),由于我國(guó)的傳統(tǒng)國(guó)情、老年人法律意識(shí)日益提升,祖父母與孫子女之間基于共同生活而積累起來(lái)的深厚感情使他們對(duì)孫子女也有強(qiáng)烈的探望需求。司法實(shí)踐中,此類(lèi)糾紛不斷上升,但是因?yàn)榉蓪?duì)祖父母是否享有探望權(quán)沒(méi)有明確的規(guī)定,法院對(duì)此類(lèi)糾紛的判決也不一致,因此有必要對(duì)祖父母探望權(quán)問(wèn)題進(jìn)行全面研究。本文除引言外,包含三個(gè)部分。第一部分：我國(guó)祖父母探望權(quán)的司法現(xiàn)狀及引出問(wèn)題。本部分通過(guò)我國(guó)法院對(duì)隔代探望權(quán)糾紛案件判決的對(duì)比,說(shuō)明我國(guó)祖父母探望權(quán)糾紛案件的司法現(xiàn)狀,引出我國(guó)祖父母探望權(quán)問(wèn)題需要進(jìn)一步探討。第二部分：我國(guó)祖父母享有探望權(quán)的辨證關(guān)系。本部分通過(guò)正反兩個(gè)方面討論我國(guó)祖父母享有探望權(quán)的辨證關(guān)系得出祖父母享有探望權(quán)利大于弊的結(jié)論。第三部分：我國(guó)祖父母探望權(quán)的法律構(gòu)建。本部分從確立兒童最大利益原則、祖父母享有探望權(quán)的條件、祖父母行使探望權(quán)的方式及侵害祖父母探望權(quán)的法律責(zé)任四個(gè)方面全面展開(kāi)對(duì)祖父母探望權(quán)的討論。
[Abstract]:It has been 16 years since the entry of visitation right, but whether the subject scope of visitation right should be expanded to present is still uncertain. In our country, due to the traditional situation of our country, the legal consciousness of the elderly is rising day by day. The deep feelings accumulated between grandparents and grandchildren based on living together make them have a strong need to visit their grandchildren. In judicial practice, such disputes are on the rise. However, because the law has no clear provisions on whether grandparents enjoy visitation rights, and the court's judgment on such disputes is inconsistent, it is necessary to conduct a comprehensive study on the issue of grandparents' visitation rights. It includes three parts. The first part: the judicial status quo of grandparents' visitation right in our country and the problems arising from it. This part explains the judicial status of the grandparents' visitation right dispute cases through the comparison of the judgments of our country's courts on the disputes of the next generation visitation rights. Part two: dialectical relationship between grandparents' visitation rights in China. This part discusses the dialectical relationship between grandparents' visitation rights in China through positive and negative aspects. The third part: the legal construction of the visiting right of grandparents in China. This part establishes the principle of the best interests of the child. The conditions of grandparents' visitation rights, the ways of grandparents' exercising visitation rights and the legal liability of encroaching on grandparents' visitation rights are discussed in an all-round way.
