【摘要】：本文對現(xiàn)行立法及司法實踐存在的對未成年子女利益考慮不夠和保護不足及缺乏有效監(jiān)管與救助問題,尤其是針對父母離婚后未成年子女財產(chǎn)的性質(zhì)界定和保護,撫養(yǎng)費的合理使用、監(jiān)督與救濟,以及人工生育子女的法律地位和離婚時撫養(yǎng)等問題現(xiàn)行立法或呈現(xiàn)空白或很不完善的狀況,進行了分析和思考。借鑒外國婚姻家庭制度的有益規(guī)則,提出了一些立法建議和具體對策,著重強調(diào)在完善離婚立法中應最大限度地凸顯保護未成年子女的合法權(quán)益,以充分體現(xiàn)兒童最佳利益原則。
[Abstract]:In this paper, the problems of inadequate consideration and protection of the interests of minor children and the lack of effective supervision and relief exist in the current legislation and judicial practice, especially the definition and protection of the property of minor children after the divorce of parents, are discussed in this paper. The current legislation on the rational use of alimony, supervision and relief, the legal status of children born artificially and the maintenance of children at the time of divorce is either blank or imperfect. This paper analyzes and thinks about it, draws lessons from the beneficial rules of foreign marriage and family system, puts forward some legislative suggestions and concrete countermeasures, and emphasizes that the legal rights and interests of minor children should be maximized in the process of perfecting divorce legislation. In order to fully reflect the principle of the best interests of the child.
