【摘要】：英美法國家制定法均以"兒童最大利益原則"作為處理離婚后子女監(jiān)護(hù)的基本原則,并在司法實踐中就該原則的適用進(jìn)行了有益的探索。對英美法國家離婚后子女監(jiān)護(hù)"兒童最大利益原則"的立法及司法實踐進(jìn)行探討,可以為我國相關(guān)立法及司法提供借鑒。
[Abstract]:The principle of the best interests of the child is regarded as the basic principle of the custody of children after divorce. This paper also explores the application of this principle in judicial practice, and probes into the legislation and judicial practice of the principle of "the best interests of the child" in the custody of children after divorce in Anglo-American countries, which can be used as a reference for the relevant legislation and judicature in our country.
