【摘要】：人的存在是一種性存在。對(duì)性的必要的法律認(rèn)可與寬容應(yīng)當(dāng)是現(xiàn)代法律與法學(xué)研究的基本態(tài)度。法律和法學(xué)研究?jī)H僅看到性是維持婚姻和生育的手段是不夠的，必須從人權(quán)的角度承認(rèn)性本身就可以是目的。性權(quán)利是一項(xiàng)重要的基本人權(quán)，它是一個(gè)內(nèi)容豐富的權(quán)利體系，性自由、性平等、追求性幸福是其主要內(nèi)容。理解現(xiàn)代性權(quán)利觀念，有助于解決很多理論和實(shí)踐上的爭(zhēng)議問(wèn)題。從長(zhǎng)遠(yuǎn)的觀點(diǎn)看，憲法應(yīng)當(dāng)確定性權(quán)利保護(hù)與性權(quán)利平等原則。 本文先從歷史的角度分析了性與法的漸近關(guān)系，指出性逐漸進(jìn)入法律的調(diào)整領(lǐng)域，法律逐步承認(rèn)并保護(hù)平等的性權(quán)利，是性與法歷史發(fā)展的客觀規(guī)律。人權(quán)作為現(xiàn)代化法律觀念之一，必然應(yīng)當(dāng)包含有性權(quán)利保護(hù)與發(fā)展的內(nèi)容。 其次，文章結(jié)合西方近現(xiàn)代性權(quán)利演進(jìn)的歷史，以歐洲及美國(guó)的幾個(gè)典型性權(quán)利相關(guān)案件為例，，對(duì)西方性自主權(quán)、性平等權(quán)、追求性幸福權(quán)等現(xiàn)代權(quán)利觀念及相關(guān)法律實(shí)踐做了歸納；同時(shí)還對(duì)法律在性領(lǐng)域作用的界限進(jìn)行了論證，指出法律對(duì)性領(lǐng)域的調(diào)整應(yīng)當(dāng)持積極且謹(jǐn)慎的態(tài)度。 最后，本文結(jié)合各部門法規(guī)定，從實(shí)證的角度，反思了我國(guó)目前性相關(guān)權(quán)利保護(hù)制度。文章認(rèn)為，從性權(quán)利是一個(gè)基本人權(quán)的范疇出發(fā)，我國(guó)目前的婚姻法及配偶權(quán)制度、反性騷擾制度、刑法中強(qiáng)奸罪制度、關(guān)于同性戀及生育權(quán)制度、乃至公民的變性權(quán)制度都函待完善或建立。
[Abstract]:The existence of human beings is a kind of sexual existence. The necessary legal recognition and tolerance of sex should be the basic attitude of modern legal and legal research. It is not enough for legal and legal research to see that sex is a means of maintaining marriage and childbearing. It must be recognized from a human rights perspective that sex can be an end in itself. Sexual rights are an important fundamental human right, a rich system of rights, sexual freedom, sexual equality, The pursuit of sexual happiness is its main content. Understanding the concept of modern rights is helpful to solve many controversial problems in theory and practice. In the long run, the constitution should be based on the principle of deterministic protection of rights and equality of sexual rights. This paper first analyzes the asymptotic relationship between sex and law from the historical point of view, and points out that sex gradually enters the field of legal adjustment, and the law gradually recognizes and protects equal sexual rights. Human rights, as one of the modern legal concepts, must contain the content of the protection and development of sexual rights. Secondly, based on the history of the evolution of modern sexual rights in the West, taking several typical cases related to sexual rights in Europe and the United States as examples, the article gives the right to sexual autonomy and equality in the West. This paper summarizes the concept of modern rights such as the pursuit of the right to sexual happiness and the relevant legal practice, and at the same time demonstrates the limits of the role of law in the field of sex, and points out that the law should adopt a positive and cautious attitude towards the adjustment of the field of sex. Finally, according to the provisions of various departments and laws, this paper reflects on the current protection system of sexual rights in China from the perspective of empirical evidence. The article holds that, starting from the category of sexual rights as a basic human right, the present marriage law and spouse right system in our country. The anti-sexual harassment system, the criminal law system of rape, the system of homosexuality and reproductive rights, and even the transgender rights of citizens all need to be perfected or established.
