【摘要】：彩禮制度是我國(guó)一種傳統(tǒng)的婚嫁習(xí)俗,我國(guó)農(nóng)村和城市普遍存在給付彩禮的現(xiàn)象,尤其是在廣大農(nóng)村地區(qū),給付彩禮甚至成為結(jié)婚前的必經(jīng)程序。近年來(lái),由彩禮返還引發(fā)的案件糾紛日漸增多。如何認(rèn)識(shí)并處理好此類(lèi)糾紛,對(duì)于維護(hù)當(dāng)事人的合法權(quán)益,化解當(dāng)事人之間的矛盾,以及對(duì)社會(huì)的和諧穩(wěn)定都具有十分重要的作用。然而,我國(guó)目前有關(guān)彩禮的法律規(guī)定過(guò)于籠統(tǒng),而司法審判活動(dòng)中遇到的彩禮糾紛又各種各樣、千差萬(wàn)別,僅依靠現(xiàn)有規(guī)定處理彩禮糾紛類(lèi)案件顯然不夠。因此,為解決實(shí)際問(wèn)題,本文試從彩禮的含義出發(fā),簡(jiǎn)要介紹我國(guó)現(xiàn)有規(guī)定,并指出司法實(shí)踐中存在的問(wèn)題,提出相應(yīng)的完善建議,以期引起有關(guān)部門(mén)的重視,達(dá)到解決實(shí)際問(wèn)題的目的。本文除引言和結(jié)語(yǔ)部分外,共分為四個(gè)部分：第一部分簡(jiǎn)述彩禮的含義及其性質(zhì),并指出本文作者對(duì)于彩禮性質(zhì)的觀點(diǎn)。第二部分簡(jiǎn)述我國(guó)彩禮返還規(guī)制的現(xiàn)有規(guī)定,并對(duì)《婚姻法司法解釋(二)》中相關(guān)法律用語(yǔ)的理解進(jìn)行介紹。第三部分簡(jiǎn)要介紹我國(guó)彩禮糾紛的典型類(lèi)型并引入案例,借由案例分析指出我國(guó)司法實(shí)踐中,處理彩禮類(lèi)糾紛時(shí)存在的問(wèn)題。第四部分是關(guān)于司法機(jī)關(guān)在處理彩禮類(lèi)糾紛時(shí),應(yīng)當(dāng)堅(jiān)持的原則的介紹及彩禮糾紛返還規(guī)制的完善建議。該部分所介紹的相關(guān)原則是在無(wú)明確法律規(guī)定時(shí),司法機(jī)關(guān)應(yīng)當(dāng)以所述原則為基礎(chǔ),并綜合考慮本部分所提相應(yīng)完善建議,在此基礎(chǔ)上對(duì)相應(yīng)問(wèn)題進(jìn)行處理。
[Abstract]:The bride price system is a kind of traditional marriage custom in our country. The phenomenon of paying the bride price exists generally in the countryside and city of our country. Especially in the vast rural areas, the payment of the bride price even becomes a necessary procedure before marriage. In recent years, The disputes caused by the return of the bride price are increasing day by day. How to understand and deal with such disputes well will protect the legitimate rights and interests of the parties and resolve the contradictions between the parties. However, the current legal provisions on bride price in our country are too general, and the disputes of bride price encountered in judicial activities are various and varied. It is obviously not enough to rely on the existing regulations to deal with cases of bride price disputes. Therefore, in order to solve the practical problems, this paper tries to introduce briefly the existing regulations of our country from the meaning of bride price, and points out the problems existing in judicial practice. In order to arouse the attention of relevant departments and achieve the purpose of solving practical problems, this paper is divided into four parts except the introduction and conclusion: the first part briefly describes the meaning and nature of the bride price. And points out the author's views on the nature of the bride price. The second part briefly describes the existing regulations of the regulation of the return of the bride price in China. The third part briefly introduces the typical types of bride price disputes in our country and introduces the cases, and points out the judicial practice of our country by case analysis. Some of the problems in handling disputes about bride price. 4th is about the judicial organs dealing with disputes in the category of bride price. Introduction of the principles to be adhered to and suggestions for perfecting the regulations governing the return of bride price disputes. The relevant principles introduced in this part are that, in the absence of clear legal provisions, the judicial organs should base themselves on the said principles, On the basis of comprehensive consideration of the corresponding suggestions in this part, the corresponding problems are dealt with.
