【摘要】：本文擬從"文學(xué)與法律比較研究"的視角論述英國文學(xué)史上著名作家托馬斯·哈代的悲劇小說《苔絲》中的法律問題。哈代對(duì)法律的關(guān)注以及濃厚興趣,使得我們從法律視野進(jìn)行審視成為可能。從財(cái)產(chǎn)繼承法、婚姻法、刑法等三個(gè)方面探究苔絲悲劇命運(yùn)的法律淵源,能為我們闡釋哈代悲劇作品及其悲劇人物提供一個(gè)新的視角,從而讓我們感受到,這部以主人公死亡作為結(jié)局的悲劇小說不僅是性格的悲劇、命運(yùn)的悲劇,還是法律的悲劇。
[Abstract]:This paper discusses the legal problems in Thomas Hardy's tragic novel Tess from the perspective of the Comparative study of Literature and Law. It makes it possible for us to examine the tragic fate of Tess from three aspects: inheritance law, marriage law and criminal law, which can provide a new angle of view for us to interpret Hardy's tragic works and their tragic characters. So we can feel that this tragic novel with the hero's death as the ending is not only the tragedy of character, the tragedy of fate, but also the tragedy of law.
