【摘要】：家庭是社會(huì)的細(xì)胞,婚姻是時(shí)代的鏡子�；橐黾彝サ臍v史,實(shí)際上是一個(gè)社會(huì)、一個(gè)時(shí)代的縮影。而用于記載婚姻家庭制度變遷的便是婚姻法。 對(duì)婚姻家庭關(guān)系的法律調(diào)整,涉及到男女老少、方方面面的切身利益和社會(huì)公共利益。除了婚姻法,沒有哪一部法律的修改和催生會(huì)如此萬眾矚目和眾說紛紜,這不僅是因?yàn)榛橐龇ㄅc每個(gè)公民的基本人權(quán)和千家萬戶的生存質(zhì)量有關(guān),還在于婚姻法是一個(gè)時(shí)代變遷和社會(huì)文化轉(zhuǎn)型的晴雨表。 正是由于婚姻法與婚姻家庭之間如此密不可分的關(guān)系,本文將二者結(jié)合起來進(jìn)行研究,系統(tǒng)考察了建國以來婚姻法的發(fā)展變化,通過具體分析婚姻法與婚姻家庭之間的互動(dòng)關(guān)系,揭示婚姻法變動(dòng)的內(nèi)容、特點(diǎn)以及所反映的社會(huì)變化,以期為更好地結(jié)合我國婚姻家庭現(xiàn)狀,制定出適應(yīng)社會(huì)婚姻家庭領(lǐng)域新情況的婚姻法打好理論基礎(chǔ)。由于當(dāng)代中國婚姻法涉及婚姻家庭領(lǐng)域的方方面面,而婚姻家庭問題更是形形色色、較為復(fù)雜。本文化繁為簡,以小見大,以1950年以來婚姻法的三次變動(dòng)為研究脈絡(luò),結(jié)合各個(gè)時(shí)期的社會(huì)背景,分階段選取了對(duì)婚姻家庭有重要影響的問題來進(jìn)行研究。 本文以當(dāng)代中國婚姻法和婚姻家庭為研究重點(diǎn),查閱了大量相關(guān)資料,采用歷史學(xué)、法學(xué)、社會(huì)學(xué)相結(jié)合的研究方法,通過對(duì)當(dāng)代中國婚姻法與婚姻家庭的考察與梳理,注重理論與實(shí)踐的結(jié)合,更為深入地探查現(xiàn)行制度的缺失,以期為完善我國婚姻法及促進(jìn)婚姻家庭制度的良性發(fā)展提供依據(jù)和學(xué)術(shù)支撐。 本文首先對(duì)婚姻法與婚姻家庭進(jìn)行了概念界定,然后對(duì)我國婚姻家庭法制演變的歷史進(jìn)行了系統(tǒng)的回顧：分別敘述了我國婚姻家庭法制的產(chǎn)生與發(fā)展、近代中國婚姻家庭法制的變革、新中國的婚姻家庭法制等不同歷史階段中國婚姻家庭法制的整體框架,旨在了解中國婚姻法與婚姻家庭關(guān)系的歷史發(fā)展脈絡(luò),并為古今婚姻家庭法律制度的對(duì)比提供依據(jù)。然后把目光放到當(dāng)代中國婚姻家庭法制上面來,以新中國兩部《婚姻法》及一部《婚姻法》修正案為研究脈絡(luò),分別從廢舊立新——1950年《婚姻法》、傳承與創(chuàng)新——1980年《婚姻法》、21世紀(jì)婚姻家庭法律的新篇章——2001年《婚姻法》修正案幾個(gè)方面系統(tǒng)闡述了我國當(dāng)代婚姻法的發(fā)展演變,并從中穿插了我國不同歷史時(shí)期的婚姻家庭領(lǐng)域熱點(diǎn)問題及其與婚姻法之間的互動(dòng)關(guān)系,著重討論了幾部婚姻法的歷史功績與不足。之后,從當(dāng)前婚姻家庭焦點(diǎn)問題入手,分別列舉了我國目前一些具有典型代表性的婚姻家庭領(lǐng)域焦點(diǎn)問題,理論與實(shí)踐相結(jié)合,分析問題產(chǎn)生的原因、深入探查現(xiàn)行制度的缺失,提出解決相關(guān)問題的法律建議。最后,是余論：理想的婚姻法與婚姻家庭關(guān)系——婚姻家庭的“幸福夢(mèng)”。分別從婚姻是什么、理想的男女平等的婚姻模式和法律的角色三個(gè)方面進(jìn)行闡述,解析筆者心目中理想的婚姻法與婚姻家庭關(guān)系。
[Abstract]:Family is the cell of the society. Marriage is the mirror of the times. The history of marriage and family is actually a miniature of a society and an era. The marriage law is used to record the change of marriage and family system.
The legal adjustment of the relation of marriage and family, everyone involved, all aspects of personal interests and social public interests. In addition to the marriage law, no modification of the law and the birth of so much attention and Public opinions are divergent., this is not only because of the quality of life of basic human rights and marriage law and thousands of households every citizen of that marriage law is one of the changes of the times and social cultural transformation barometer.
It is because of such a close relationship between the marriage and family, the combination of the two studies, the system examines the changes and development of the marriage law since the founding of new China, through the interaction between the specific analysis of the marriage and family, marriage law changes reveal the content, characteristics and social changes reflected, in order for a better combination of family status marriage in our country, to formulate a new marriage law of marriage and family social field to lay the theoretical foundation. The contemporary Chinese marriage law relates to the field of marriage and family aspects, and marriage and family problems is more complex. The culture of every hue, to simplify, to the child is father of the man since 1950 three. Changes of the marriage law as the research context, combined with various periods of social background, stage selection has important influence on the marriage and family problems to study.
Based on the contemporary Chinese marriage law and marriage and family as the research focus, consulting the relevant information, using history, jurisprudence, sociological research methods combined, through the investigation and review of contemporary China marriage and family, the combination of theory and practice, the lack of more in-depth exploration of the existing system, to provide the basis for academic support and perfect marriage law of our country and promote the healthy development of the marriage and family system.
Firstly, the marriage and family concept, and then made a systematic review on the evolution of China's legal system of marriage and family history: describes the emergence and development of China's marriage law system, the modern Chinese marriage law system reform, the overall framework of the marriage family law in different historical stages of new Chinese marriage the family Chinese legal system, aimed at understanding the historical development of the relationship between marriage and family China, and provide the basis for the comparison of ancient and modern legal system of marriage and family. And then focus on the contemporary marriage and family legal Chinese above, with two "new marriage law" and a "China marriage law" amendment to the research context Lixin, respectively - 1950 "marriage law" from the waste, inheritance and Innovation -- "marriage law" in 1980 twenty-first Century, a new chapter of marriage and family law in 2001 "marriage law" amendment to a few A system on the development of China's contemporary marriage law evolution, and from the hot issues in the field of marriage and family with different historical periods in China and its interrelationship with the marriage law, marriage law focuses on several historical merit and shortcomings. Then, starting from the current marriage and family problems are listed our country some typical issues of marriage and family, the combination of theory and practice, analyzes the causes of the problems, the lack of in-depth exploration of the current system, put forward the legal suggestions to solve the related problems. Finally, is the conclusion: the ideal marriage and family relationships, marriage and family happiness dream "what is marriage.
