【摘要】：作為一種新型的產(chǎn)業(yè)合同,移動(dòng)電信服務(wù)合同在實(shí)踐中暴露出諸多問題。其根源可以歸結(jié)為技術(shù)原因、管理原因以及權(quán)利維護(hù)成本等多方面。電信服務(wù)合同的法律規(guī)范包括合同法和電信法兩種,我國應(yīng)當(dāng)確立以電信法規(guī)范為主、以合同法規(guī)范為輔的模式。要想在根本上平衡電信服務(wù)業(yè)中當(dāng)事人之間的均衡地位,應(yīng)當(dāng)成立獨(dú)立高效的電信服務(wù)監(jiān)管機(jī)制,加大對(duì)違規(guī)行為的審查和處罰力度,強(qiáng)化媒體監(jiān)督,注重糾紛處理的前置性審監(jiān)模式。
[Abstract]:As a new type of industrial contract, mobile telecommunication service contract has exposed many problems in practice. Its roots can be summed up to technical reasons, management reasons and rights maintenance costs and so on. The legal norm of telecommunication service contract includes contract law and telecommunication law. Our country should establish a mode which is dominated by telecommunication law and supplemented by contract law. In order to fundamentally balance the balanced position of the parties involved in the telecommunications service industry, we should establish an independent and efficient regulatory mechanism for telecommunications services, strengthen the scrutiny and punishment of violations, and strengthen the supervision of the media. Pay attention to the pre-trial supervision mode of dispute handling.
