【摘要】：對價是英美契約法的獨特內容。對價原則在現代契約法中的衰落有其歷史必然性,但在英美契約法體系中沒有可以代替對價的制度或原理,對價不可能被輕易廢除。對價的本質是靈活的,對價的體系是開放的,對價將繼續(xù)作為英美契約的構成要件而存在,但是它需要進一步的改革與創(chuàng)新。
[Abstract]:Consideration is the unique content of Anglo-American contract law. The decline of consideration principle in modern contract law has its historical inevitability, but there is no system or principle that can replace consideration in Anglo-American contract law system, and consideration cannot be easily abolished. The essence of consideration is flexible and the system of consideration is open. Consideration will continue to exist as an essential element of Anglo-American contract, but it needs further reform and innovation.
