集體土地上商品房產(chǎn)權(quán)的合法化問(wèn)題研究

【摘要】:近年來(lái),房?jī)r(jià)的不斷飆升,使得越來(lái)越多的買不起國(guó)有建設(shè)用地上商品房的城市居民開(kāi)始關(guān)注建造在集體土地上的商品房。所謂集體土地上的商品房就是建造在農(nóng)村集體土地上用于向不特定人出售的商品房,人們通常將其稱之為“小產(chǎn)權(quán)房”。不管是“小產(chǎn)權(quán)房”還是“集體土地上的商品房”都是人們對(duì)建造在非國(guó)有建設(shè)用地上的商品房的一個(gè)稱謂,并非法律層面的規(guī)范概念。人們?yōu)槭裁匆獙⒔ㄔ煸诩w土地上的商品房稱之為“小產(chǎn)權(quán)房”呢?其與國(guó)有建設(shè)用地上的商品房相比有何不同?產(chǎn)權(quán)上存在哪些差異?為什么國(guó)務(wù)院發(fā)布的一系列政策文件一再禁止將其賣與城市居民,卻禁而不止呢?本文基于這一系列的未決問(wèn)題,以提出問(wèn)題、分析問(wèn)題、解決問(wèn)題的思路來(lái)論述寫(xiě)作,除緒論和結(jié)語(yǔ)以外,分為四個(gè)部分。 第一部分分析了集體土地上商品房產(chǎn)權(quán)性質(zhì)存在的理論爭(zhēng)議,包括集體土地上商品房的產(chǎn)權(quán)現(xiàn)狀,有關(guān)集體土地上商品房產(chǎn)權(quán)存在的不同學(xué)說(shuō),以及這些產(chǎn)權(quán)爭(zhēng)議的根源,這是問(wèn)題的提出部分。 第二部分對(duì)集體土地上商品房產(chǎn)權(quán)問(wèn)題出現(xiàn)的成因進(jìn)行分析,包括歷史分析、法律分析和理論分析三個(gè)方面,將集體土地上商品房產(chǎn)權(quán)問(wèn)題出現(xiàn)的歷史根源、現(xiàn)行法律規(guī)定不足、土地產(chǎn)權(quán)理論存在問(wèn)題進(jìn)行說(shuō)明,屬于問(wèn)題的分析部分,從否定的、反面的角度分析論證集體土地上商品房產(chǎn)權(quán)可以予以合法化。 第三部分是關(guān)于集體土地上商品房產(chǎn)權(quán)合法性的理論分析,包括合憲性分析,私權(quán)性分析以及從合同法的合同效力認(rèn)定角度分析房屋買賣合同無(wú)效的認(rèn)定依據(jù)不足。這部分也是屬于問(wèn)題的分析部分,是從肯定的、靜態(tài)的角度論證分析集體土地上商品房產(chǎn)權(quán)可以予以合法化。 第四部分在前面分析論證的基礎(chǔ)上得出現(xiàn)存的集體土地上的商品房產(chǎn)權(quán)給予合法化有其必要性,并給出解決方案,對(duì)地方上的一些有益實(shí)踐的借鑒,對(duì)將來(lái)徹底解決該問(wèn)題提出建議:建立集體建設(shè)用地使用權(quán)自由合法流轉(zhuǎn),并對(duì)該制度的構(gòu)建提出可行性建議。
[Abstract]:In recent years, with the soaring of house prices, more and more urban residents who can not afford commercial housing on state-owned construction land begin to pay attention to the commercial housing built on collective land. The so-called commercial housing on collective land is built on the rural collective land for sale to non-specific people, people usually call it "small property house". Whether it is "small property right" or "commercial house on collective land", it is a term that people build on non-state-owned construction land, and it is not a legal standard concept. Why do people call commercial houses built on collective land "small property houses"? How is it different from the commercial housing on the state-owned construction land? What are the differences in property rights? Why is it that a series of policy documents issued by the State Council have repeatedly banned the sale of them to urban residents? Based on this series of outstanding questions, this paper discusses the writing with the ideas of putting forward, analyzing and solving the problems, which is divided into four parts except the introduction and the conclusion. The first part analyzes the theoretical disputes about the property right of commercial housing on collective land, including the present situation of property right of commercial house on collective land, the different theories about the existence of property right of commercial house on collective land, and the origin of these disputes. This is the part of the question. The second part analyzes the causes of the emergence of the property rights of commercial housing on collective land, including historical analysis, legal analysis and theoretical analysis of the historical origin of the emergence of the property rights of commercial housing on collective land. The existing laws and regulations are insufficient, the problems existing in the theory of land property rights are explained, belong to the analysis part of the problems, from the negative and negative angle, it is proved that the property rights of commercial housing on collective land can be legalized. The third part is the theoretical analysis of the legality of the property right of commercial housing on collective land, including constitutional analysis, private rights analysis and the analysis of the validity of the contract law from the point of view of the contract law. This part is also part of the analysis of the problem, from a positive, static point of view to analyze the collective land property rights of commercial housing can be legalized. The fourth part draws the conclusion that it is necessary to legalize the commercial housing property right on the existing collective land on the basis of the above analysis and argumentation, and gives the solution, which can be used for reference to some beneficial practices in the local areas. Some suggestions are put forward to solve the problem in the future: establishing the free and legal circulation of the right to use collective construction land, and putting forward some feasible suggestions for the construction of the system.
