應(yīng)對(duì)西方海上保險(xiǎn)壟斷的法律對(duì)策
[Abstract]:Marine insurance has been providing support and protection for ocean shipping, shifting and dispersing the risks of cargo owners and shipowners. Up to now, although many countries and regions are actively engaged in marine insurance business, European countries still have a monopoly position in the marine insurance industry and use their monopoly position and advantages to control the global marine insurance and reinsurance business. And thus control and influence global shipping and international trade, and thus affect international politics, military and regional security. Chinese marine insurers often go to Europe to arrange reinsurance and are therefore subject to Western monopolies. In order to provide effective insurance protection for China's ocean shipping industry, it is particularly important to deal with the western marine insurance monopoly. Therefore, this paper suggests that if a well-functioning marine insurance market can be established in China, it can be used within the market to underwrite marine risks by means of partial share subscription by multiple insurers. Thus do not need to seek reinsurance in western countries to achieve the purpose of risk diversification. At the same time, by taking advantage of the opportunity to establish an insurance market in China, we can also use insurance products that are more suitable for China's ocean-going shipping vessels in the insurance market, without having to follow the western marine insurance industry to distinguish ship insurance. The traditional method of insurance can combine the two under one policy to give play to the advantages of a package insurance contract. Therefore, this paper discusses the application of the basic principles of marine insurance contract law to the new package insurance.
