【摘要】：技術(shù)開發(fā)合同產(chǎn)生的技術(shù)成果權(quán)屬研究對(duì)我國(guó)技術(shù)市場(chǎng)發(fā)展具有重要意義。本文闡述了依據(jù)《合同法》規(guī)定產(chǎn)生的技術(shù)成果權(quán)屬的四種形式,分析了合同當(dāng)事人自行約定技術(shù)開發(fā)成果權(quán)屬產(chǎn)生的問(wèn)題和缺陷,提出了技術(shù)成果權(quán)屬歸研究開發(fā)方所有的基本原則。
[Abstract]:The research on the ownership of technological achievements arising from technology development contract is of great significance to the development of technology market in China. This paper expounds four forms of ownership of technological achievements according to the contract Law, and analyzes the problems and defects of the ownership of technological development achievements as agreed by the contract parties themselves. The basic principle that the ownership of technical achievements belongs to the R & D is put forward.
