【摘要】：情勢變更原則的法理基礎(chǔ)是誠實(shí)信用衡平學(xué)說。我國合同法中應(yīng)規(guī)定情勢變更原則 ,它與誠實(shí)信用原則不同 ,認(rèn)為在合同法中確立情勢變更原則可能導(dǎo)致法官濫用自由裁量權(quán) ,就此否定其在合同法中的確立 ,無異于因噎廢食。情勢變更是合同嚴(yán)守原則的例外 ,它包括不可抗力 ,并產(chǎn)生兩大法律效果 :雙方當(dāng)事人再交涉義務(wù) ;雙方當(dāng)事人獲得請求法院變更或解除合同權(quán)。
[Abstract]:The legal basis of the principle of change of circumstances is the theory of balance of good faith and credit. The principle of change of circumstances should be stipulated in the contract law of our country, which is different from the principle of good faith. It holds that the establishment of the principle of change of circumstances in contract law may lead to the abuse of discretion by the judge, thus negating its establishment in the contract law. It is tantamount to eating for choking. Situation change is an exception to the strict principle of contract. It includes force majeure and produces two major legal effects: the obligation of the parties to negotiate again and the right of both parties to request the change or rescission of the contract by the court.
