【摘要】：預(yù)期違約制度是合同法上違約制度的重要組成部分,也是英美法系一項(xiàng)獨(dú)創(chuàng)制度�！豆s》吸納了英美法系的該項(xiàng)理論,但又有所發(fā)展。本文通過(guò)比較研究的方法,對(duì)英美法、《公約》中預(yù)期違約制度的構(gòu)成條件及救濟(jì)措施的考察,分析其規(guī)定的優(yōu)劣,以期在國(guó)際貨物買(mǎi)賣(mài)實(shí)踐中找到保護(hù)當(dāng)事人的權(quán)益、保障交易的順利進(jìn)行的好辦法,促進(jìn)國(guó)際貿(mào)易的發(fā)展。
[Abstract]:The system of anticipatory breach of contract is an important part of the system of breach of contract and an original system of Anglo-American legal system. In this paper, by means of comparative study, the author investigates the constitution conditions and relief measures of anticipatory breach of contract in Anglo-American law and the Convention, and analyzes the advantages and disadvantages of its provisions, in order to find and protect the rights and interests of the parties in the practice of international sale and purchase of goods. A good way to ensure the smooth progress of the trade and promote the development of international trade.
