【摘要】:房屋承租人的優(yōu)先購買權(quán)是指房屋承租人在一定的條件下對其所租賃的房屋享有較之一般的購買人優(yōu)先購買的權(quán)利。優(yōu)先購買權(quán)在羅馬法的時期業(yè)已存在,并經(jīng)由《法國民法典》、《德國民法典》和《瑞士民法典》的繼承和發(fā)展。我國《合同法》第230條、《最高人民法院關(guān)于審理城鎮(zhèn)房屋租賃合同糾紛案件具體應(yīng)用法律若干問題的解釋》第21-24條等均對于房屋承租人的優(yōu)先購買權(quán)做出了規(guī)定,但是從很多方面看,我國的法律仍有許多不完備的地方。尤其是在審判實踐中仍有許多疏漏和不足的地方,法律對該問題的相關(guān)規(guī)定也不夠完備,對若干重要問題也沒有作出相應(yīng)的規(guī)定,個別制度設(shè)計亦尚有值得探討之處。 在現(xiàn)實經(jīng)濟交往中,由于房屋所有權(quán)人將已經(jīng)出租的房屋出售給第三人而與承租人產(chǎn)生糾紛,或損害承租人優(yōu)先購買權(quán)的案件時有發(fā)生。而在審判實踐中由于對房屋承租人優(yōu)先購買權(quán)的法律性質(zhì)認(rèn)識不一,導(dǎo)致對案件的實體處理不盡相同。本文試圖結(jié)合現(xiàn)行的法律,,通過對承租人的優(yōu)先購買權(quán)性質(zhì)的法理探討,并結(jié)合相關(guān)的實際案例進行分析,以期對審判實踐有所裨益。

Especially there are still many omissions and deficiencies in the judicial practice, the relevant provisions of the legal issues is not complete, on a number of important issues do not make corresponding regulations, individual system design is also There is something worth discussing.
In the real economic exchanges, the owner of the house will be rental housing has been sold to third people and a dispute with the lessee, the lessee preemption or damage cases have occurred. But in judicial practice because of the legal nature of the lessee's preemption is not a recognized entity, to deal with the case is not the same. This paper tries to combine the existing law to explore the legal nature of the right to buy the lessee's priority, and combined with the actual case related analysis, in order to benefit the judicial practice.
